They are allocating supplemental greencard numbers for Z visa holders with a flexible limit and this supplemental allocation will go away once all Z visa holders adjust (end of page 287 and beginning of page 288).

Now THAT is over-generalization. You think all of us Indians and Chinese get jobs as soon as we graduate in giant offshoring cos? My friend you're stereotyping. It is wrong to assume that we get our jobs because of our nationality and not our skills.
Anyway, continuing with my example. My friend and I both found jobs after a few months of struggle in small boutique consulting companies (run by Americans), mind you no offshoring. In fact my friend's sponsor is Indian, my sponsor is American!

I agree a universal 7% limit for any coutry regardless of its population and number of college graduates is stupid.. the percentages need to be adjusted. But to tell me that the 3 unretrogressed have to stand at the end of the line behind the equally qualified 20 retrogressed who came here faster (and chose to come here knowing their homeland is retrogressed) that is really fair.. yeah right!
Yup. Standing your turn in line is fair. And that's what needs to change. EB visas are about skills and not nationality.
You need to quit stereotyping and being unfair to us by saying we get jobs because of our nationalities. Brother, you don't get degrees or jobs because you're Indian or Chinese, but because you add value.

GC Seeker 2002 I know how if feels to be in status quo for 9-10 years. I will complete my 9 years at the end of this month.
I want to share the fact that if we channel our negative energy into something positive it helps relieve stress and at the end of the day you earn and learn something.
It does not have to be studies, for me it is studies and golf. In fact I have gotten to be good at golf too. And one of my dreams is to play on PGA tour. Well why not!!! Some of the greatest inventions have been in serendipity. Microwave, correll ware etc. You may find something too. Take Azim Premji's example. Think of of it as some greater force that is directing you to see something in front of you and is phenomenal.
Also remember that you find the lost objects only when you are not looking for them!!

We all know its not an easy 1-2-3 to happen in a jiffy for something to be debated in the Capitol hill...signed by the President..and becoming a law, against all odds of gas hikes,natural disasters,anti immigration...Immigration stands on a scale of 1 to 10,maybe number 9 or 10.
Something has to happen which may run into years, here we are already worn-out with exploitation from our employers being on H1B.
If one is below 30-35 he can go right away to India where it is booming,others beyond 40 are confused to go back, trust me..
1)it will be a whole new struggle there with all the youngsters in the job market back home
2)kids r already sort of grownup here..they need to be adjusted to the schools/curriculum there...

Thanks you all for making the post and clarifying the difference between I140 substitution vs underlying labor being used. I guess in my case the approved labor was used and not I140. I have asked my previous employer to send us the revocation request for the I140 so that my MTR is much stronger. The 2 applicant to 1 labor/I140 is exactly what has happened in my case. One of you has done a very good job of explaining it.
My current lawyers are in the process of filing for MTR. I have been delayed a bit since we never got the damn letters. I have H1b until June as a backup. My wife works on EAD--should she inform her employer or she could continue since they don't know yet.
I will continue updating this thread.

I went to SSA office today and they did not accept the application. I had all the necessary paperwork such as SSA guidenace on Non-Work Purpose SSN, Letter from IRS (one that every taxpayer got informing about Economic Stumulus Package) and FAQ regarding Basic Eligibility and ITIN for Economic Stimulus Pakcage from IRS website.
They simply refused to accept the application. This is unacceptable as I do not think lawmakers envisaged such a situation when they announced plans for Economic Stimulus Package.
Of course it is unacceptable. They cannot refuse to accept an application. How can they review your case if they wont accept your application. That is a violation of your rights. The only reason they refused your application is that you are an immigrant. You can therefore file a discrimination complaint against them using the form I attached in my earlier post. Also, contact your congressman and/or senator. They usually have a constituency services department that handles cases like these. If you want to PM me, I can help you with the specifics.

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. Nurses are already under shortage occupation list, even though some articles says otherwise! Their visas stopped from Ja. 2007. US hospitals will definitley feel the heat within months, since, much awaited their nurses are on hold at their parent country. US Hospitals have already invested funds for their CGFNS, RN. petitoning etc. Their emergency rooms will be overcrowded.. and wards will be shut down.. if visas not approved soon. .. First of all I think logiclife will go in the history of immigration books as the movers that existed in this generation. I am amazed at how motivated the IV core team is and how smoothly they have organized the whole show so far.

I read a lot of newspaper articles after the rally and they always seemed to mention that Indian and Chinese legal aliens protesting backlogs. I think there should be some effort to also include people from other nationalities such as Russians, Englishmen, Philipinos, Chinese and other nationalities. Now I know they are not hit as hard as us but they go thru some serious backlog as well if they are in the EB3 category.
Question is I am thinking how?
Any ideas guys?

I filed my labor twice with Fragomen and got rejected in 2001 and 2002.
Just for H1B visa extension they took more than 9 months. Although they have all my papers for months. Eventually, I had to leave my employer for good.
Stay away from them if you have choice.
In my case they took 10 months to file my labor back in 2001. Instead of filing my case in June 2001, they filed my LC only in the middle of Feb 2002.
Also they never provide any update. Whenever you call them, they are always away from the desk and wanted us to leave a message. Even if you leave a message you don't expect any response from them.

One way is to invest regularly in 401 K. By that way you let your investments grow tax free and if you have to or go back to India then you can withdraw them next year, TAX free or less tax. Thus you actually pay less tax and ultimately you might pay lesser tax than your social security. Who cares if the social security is being taken from me.
I thought IRS will allow you to withdraw your 401(K) with a 10% fine + all applicable taxes. Not sure how that will benefit someone who is forced to withdraw becuase he has to return to India.
