that Fragomen is a big firm but they are absolutely careless and have no regard for the eventual client / applicant. All said and done I am getting an opportunity to bash them I am not going to miss it. They have messed with my life and career. They deserve to embaressed in public :mad:.

I have been on a H4 visa for the last 3 yrs now and it's terribly frustrating...having always worked before that. But it isn't true that there aren't any takers for the H4 visa cause! Shivali Shah (who is an immigration advocate) and her organization have been working really hard for the rights of H4 visa holders. Check out her website...she's doing some great work!

Bottom line is Porting of PD from Eb3 to Eb2 worked for some people only.

Here are just a few that I can think of rightaway.
1. Once shifted to EAD you loose opportunity to renew or apply for a new H1B if you have not completed six years though.
2. You have to apply for EAD renewal every year and much in advance. H1Bs are issues for 3 year periods.

It seems that more H4's want to work in the country which they have entered as dependents and many want to compare it with other countries but did you think what made you to bring to this country other than going to those countries.You want the immigration system to change according to you rather than you changing.If you are so frustated with the system and country better to pack the bags.This country Didn't invite you and promise you.!!!!!

As far as my knowledge goes, the I 140 substitutions are no more accepted by USCIS. I may be wrong. Other members can comment..

The key is revocation vs. substitution. Normally vendors dont like going against the client. Especially after you have billed for them for a year already. Unofficially they let you go after 1 yr i.e. the vendor. Try to talk to your client and see if they are willing to apply pressure on the vendor to let you go. Also talk to your vendor and explain to him why you want to join client i.e. career growth, etc and tell your vendor that you can help him/her recruit more folks to fill in your position and stuff. Basically you will have to do some brown nosing with the vendor for the time being.
If nothing else works, ask the vendor what would it take to make this work i.e. money wise and stuff if you are willing to pony up some dough to make this happen.
Hi, I am currently on a Company A's payroll and working at a client's place (Company B); now that Company B wants me to join them; however, there is a contract between Companies A & B not to hire the employee directly; what should be done in this case? I also have a contractual obligation to my employer not to join the client for 12 months. My employer(Company A) is not willing to let me go (though I worked for a year already). Hey, mine is EB2 ROW - can't get any more straightforward than that, I-140 is approved, and PD has always been current! Well, 1 year 7 month and still counting. It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.
Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

More education generally does mean more skill. It does not always mean more pay, but this country has decided to use education and work experience as the criterion for EB category allocation.

I have pretty much the same story and am in pretty much the same situation due to PBEC and now retrogression.
I don't think returning back as a knee jerk reaction is a good idea. If you have already been here 8-9 years obviously you have been stuck in a programming job for the last 10+ years. You can't take programming experience back to home country and ask for management position. You will get no programming position because you are over qualified and no management position because you don't have the experience.
However horrible it sounds, its best to stick it out. I am personally ready to stick it out for at least 1.5 years. After that I will be forced to make a decision otherwise I will lose my canadian PR also.
Let's talk about three things:
1. Make efforts to get GC.
2. Plan for your future: Enhance your education, apply for PR in another developed country.
3. Make your present better: Enjoy everyday, don't worry about GC.
I was thinking about PMI, CISA and MBA right from the time I landed in US in 1999. Then I realized that I need to get an GC to make use of those. Then I started to look for a stable company where I can start my GC process. It took three years toll till then. I joined a good ameican company as a perm employee. They did not file my GC as they promised and I had to quit to join another company for the heck of my GC and for my (my wife with CPA / CA is on H4 for 5th year now) dream career. I had to go many step back in technology with the new company but I sucessfully managed to file my GC.
Then what? When I finished studying my PMI, all the retrogression story started. Then I had to ask questions my self.
1. With PMI certification in 2004, if I am doing a Sr. Software engineer, will it not raise questions down the line in my career interviews. May be yes or no, but I do not have answers.
2. With PMI Cert in 2004, if I can get my GC in 2005, I am pretty sure I could manage any questions throws at me, but not in 2008 or 2010. So I dropped the idea on PMI / CISA/ GMAT until I have 50% certanity of when I will be getting my GC in hand.
3. The worst will be starting an MBA with good univeristy and competing it in next two years with zero hope of getting GC then. What would you do if you are not even closer to file your 485 when you have MBA degree in hand. You will have career in your home country with this MBA for sure, but who will pay your debts here. It is like shooting yourself on your foot with golden gun. Atleast you will be satsifed it is golden gun, but the end result is hurting yourselves.
4. So what is the option? Never give up. There are always difficult times for everyone. What we are facing is nothing. There are people who are graduating at the age of 70 in US. I have seen a lady at the age of 70 graduating with MAB from Harvard. I thought she did it for fun, but in an interview she said she wants to pursue her career in marketing field. This is an eye opener for me. So prepare yourself with TOEFL and GMAT. These scores are valid for 5 years. Join from volunteer organizations and develop your leadership skills. Reco letters from these orgs will have great impact when you apply for MBA infuture. Most of all it is right way to live a peaceful life atleast if you do not go the MBA route, you will develop the skills needed for your life.
