My wife and I got involved with IV activities/volunteering about 2 months before the rally....and we are very glad we did!
Its been a very rewarding and learning experience....after meeting with the lawmakers- it has fortified our belief in IV and renewed our enthusiasm about the process. After reading Logiclife's post I am convinced that active participation is the key to achieving success!
We plan on continuing our efforts - turning sceptics into believers - it is especially needed in the DC/VA/MD!

I am not sure how MBPS is better than the system we have now . At least in the present system every one in each category gets their turn .
With the new point system A person from india may not get green card even if one has 100 points and a person from Bangladesh may get green card if that person has 50 points. On top of that in new system application gets trashed if one does not get his GC in the year he or she applied.
Any given year there would be more than 38500 people who could get close to 100 points from india whether they are employable or not ...
If country based caps are removed then I would agree that its true merit based system or MBS otherwise its just another BS...

I don't know why you are wasting your time calling uscis. The fact is that USCIS released a statement they would reject all applications. Please don't waste your valuable time and focus of media and your senators. Please don't count on miracles. For now uscis may hold the applications for a few days because of the congressional action by congresswoman Lofgran, but we should keep the momentum and increase the awareness of this important issue.

IV core group has done and continues to do a wonderful job. Many of us have to realise that this issue is MUCH MUCH larger than us. A nation is trying to decide what its immigration policy will be for the next generation. Furthermore this time its policy may even decide its ethnic majority in due course.
At times like this there will be a lot of opposing viewpoints and we should be grateful that our viewpoint will atleast be heard. Other than that, there is not a damn thing we can do. Ultimately only birthright will allow you to challenge for citizenship.
Many of us are frustrated for a variety of reasons but in the end pestering the IV core group is no help to them nor for our cause especially. I suggest we stop doing that and spare them the time explaining these issues to us, to doing other tasks which might be more useful.
Many of us have lost a lot in this process. I personally cannot even calculate what I have lost as a result of this waiting. However, it is a sacrifice I have to be ready to make if I truly want the priviledge of living here. Our humility and continued contribution to life in this country in the end will win over supporters.
If you notice, despite all the bad press about illegals, despite 9/11, the majority of americans are still pro legal immigrants, we are largely to credit for this, along with the pride they have in their forefathers who made the same journey.
It will take time, but whatever happens with CIR, I am quite certain that within the next 12-18 months there will be some relief for us legal immigrants waiting in the queue. It is the way it has always been.
I suspect relief for us will come with H1b visa relief, since the other truth of american politics is that lobbying is a big big deal here and corporate america runs this country de facto.

this is the first time i heard details about this bill even though he has been talking about it after meeting Bush. the news article thread has the analysis i found from an anti immigration group site. AILA has posted it as their news today however they have not yet posted the summary of the bill. The question is which one of the 3 --SKIL bill, CIR or Pence will be really voted and which ones will be put in the backburner for future or silent demise!
In any case, Pence is one of the co-sponsors of the SKIL bill in the house.So I dont really think his bill would exclude us.The point is at least one of those bills should progress from where they are right now .. ANY bill.

I was amused and angry at the same time. I am just wondering if we can somehow pool money and one of us can get them started by sending a $2500 check and see where it goes.
Assuming thay the information they will share is what all of us are seeking, it is not going to be a bad deal if we can find 500 people willing to chip in for this initiative (optimist me :) ).

Considering a new labor is approved in EB2 (through same or different employer), can another I-140 be filed with older EB3 PD? In that case what happens to already filed I-485 application (EB3)? Can it be adjusted with new I-140 in EB2? I was wondering if anyone has done that.

I probablly know the answer to my own question, but would like to know other opinions. My lawyere tells me this. Since the dates were current when I filed for my I485 in July, the application will be processed regardless of what the dates are right now. Another words, he thinks that even though the dates are showing as 2002, my application will be processed since when we filed, they were current.
is this true. If so, then provided I pass background check in time, i should expect my GC in a year or so. but if I have to wait until 2002 Row becomes current, in my case 2005.. then I am majorlly scrwed...

If you live in DC or nearby states you shouldn't even be thinking about it, the decision is: YES!!!! So, no way USCIS can give you EAD before you appear for FP. I am in same boat.
They need latest photo. As per requirement it should be taken within 30 days of filing the application.

When I applied for EAD in NSC (paper file) it took 45 days to approve. Now I applied EAD for spouse on June 10th, no update so far.

Now when explained like this anyone would understand. Also do see the point you are making and is worth a try. Is the core team looking into this? Do they need any assitance from us?
Some are good, but some are hard nuts, they take immigrants for granted. A lot of silent suferers constantly remain silent and crib about these Attorneys because they cannot move out of their companies and have to depend on them.

I can see sammyb's frustration but there is something to be said for collective intelligence and opnion. If we start restricting access to the site we loose out on the "Wisdom of the Crowds". A good example is free file sharing websites that have very few people contributing (<10%) but the benefit to the community is huge and the membership becomes ever larger because it is free. So as IV becomes more popular (which should be are foremost goal) there will be more people willing to contribute (even though the percentage of people contributing might still be small). I am not making a case for free loaders, instead I am making a case for free access to information.

If your case is EB2 worthy. It makes a lot of sense. I have many friends who did that and they have their GCs now. While I'm rotting in this mess... my fault: I didn't convert to EB2 which I could have.

How would one decide if the conversion has merits? In my case, I have EB3(I) PD of 2003. In the past 5 years, I've gained progressive experience thru my job. Is there any benchmarks or guidelines on when to convert from EB3 to EB2?

What I meant to say, you�ll succeed if you have the capability (with your professional knowledge, experience and skills) in your professional filed but definitely not with USCIS.
I can say, USCIS is a great leveler in this aspect. Everybody from PhD to Programmer is same in front of USCIS. All have to wait 10+ yrs with mental tension and anxiety, no matter what your caliber is and how successful you are in your profession.
Don�t get me wrong here. I also had to suffer for visa stamping, renewals, I-94 issues, PA etc in US Visa processing (nothing sever though). At the 5th yr of H1-B, I just decided.. to hell with that.....
I don't know about you guys, but, I would be heart patient with that kind of anxiety in another 5 yrs of GC process �. Really need a lion's heart to pursue US GC now days

I hate to say this and I hope I am wrong. All of us EB3 folks need to start speaking up or else our fate is sealed. I do not see any hopes of CIR passing. There is always going to be some political backlash due to the AMNESTY factor.
From what I have seen, most employers are now filing only in EB2 category. They know that filing in EB3 will see their applicants backlogged so severly that there is no hope in seeing their applications approved. So, even those with less than 5 years of experience create resumes that show 5 years to qualify for EB2. Imagine the flood of applicants in EB2 that will pour in when the dates move forward beyond July 2007. There will be a new backlog of EB2 numbers that we have to wait behind. When are we going to get our turn?
With nearly 10 years of experience and a master's degree, I am still languishing behind all these new comers who come here with fake experiences to qualify for EB2.
We EB3 folks need to speak up, and have the spill over given to the oldest filed applications IRRESPECTIVE of category. The spillover rules from what I know were defined at a later stage and not as per the original law. If we cannot get CIR passed nor a piecemeal regulation, at least let us get the spillover changed.
Or, let us en masse transfer to EB2 by porting, thereby making us all eligible for GC ahead of those that are coming in through the back door. I see them as no different from the undocumented immigrants. Breaking the ethical law at the expense of those of us who followed the law. Our positions did not require a Master's degree and I dont see why a programming position today still requires such. I also dont see why our experience today should not count towards qualifying for EB2.
