My son came to USA on H4 Visa. He completed his studies on F1 Visa and worked for some time on H1B Visa.
Then he went to Canada for higher studies. He holds Canada PR.
I am in US. If I apply for his I 130, would there be probem him visiting US on B2 Visa.

what is the right address to submit the I485 / EAD and AP using Fedex and fill it in Nebraska?
My attorney submitted my paperwork to:
850 S Street POBOX 87845 ?
I'm confused becase in the CIS site give the address in parentesis mention to write down the right POBOX.
What if she maid a mistake and send the paperwork to POBOX 87485?
PS.
I will be in DC, and we have rented a bus departing from wallace NC monday at 12:00hrs I still have sits available, we will drive to rRaleigh, the Virginia then DC

I am going on an international travel on job for 1 month during my OPT period. My OPT started in Jul 3rd 07 and I am planning to travel in the month of jan 08.
What are the documents that I need to procure for making my trip possible. Also, if someone could comapare this situation with international travel in H1 status it will be great help.

Hi All,
My hubbys PD is dec 04 Eb2. His I140 was filed on July 07 and in aug 07
we have applied for I-485.
I got the I-131 receipt notice which is having A# number.
Does A# number means 140 approval ? Online status of 140 shows as pending?

I am not sure what is so important in this to answer.
As long as thay had sent the finger prints to you, you should be OK. There is no particular pattern in which they send the EAD cards. So, no body can answer your question about when will you get the EAD. Just pray and watch. If it is more than 90 days since you have applied for your EAD, then you may contact your local office to expedite the process.

Does anyone know if EAD renewal requires an employment at the time of renewal? My I140 have been approved and I485 pending for long time under EB2-NIW. Also, do I loose legal status to stay in USA if I lost employment while my I485 pending. Again, my GC application is not company sponsored, it was all by myself. Do I stay in right status even I become unemployed while my I485 pending. My I485 will be pending for few more years due to retrogession. So I am wondering if I can stay as unemployed for a period of time while my AOS pending.
Also, do I need to have an employment while re-entering using AP? I recently used my EP to re-enter but no question was asked about employment. I am thinking if I can use AP for re-entry if I travel outside while I am unemployed. I have to think about all this options as chaotic situation is going on the company and layoff might be inevitable.
Please please reply. Thanks a lot!

you can claim him if:
1) He didn't earn more than $3500 in 2010
2) You have proof of providing more than 50% of his expenses (ie. paid his tuition etc.)
3) He was in the US for more than 180 days in 2010 (ie. US resident for tax purposes)
If you paid for his tuition, you may be able to claim tuition credits for him too.

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.
We suggest all applicants of I-131 to file it in time to get the AP approval before leaving the U.S., otherwise it could have dire consequences and may result in an individual not being able to re-enter. folks, with a lot of effort I got to know the case number of my AEC filed during mid 2001 ( P2002-XXXXX ) (EB3 RIR)
my company did not respond to the NOF due to lack of hiring and layoff's in the company... and then their policy is not to share the case number with the employee...
a standard answer that 'the application will be denied and has been denied' is being given by the HR.
what all can I try to get the status of this application... I have tried to email info@dallas BEC address and they wanted more info and currently awaiting their reply..
what would be the result of such an application? when NOF has not been responded to...
if a case has been denied..will there not be any paperwork from the SWA that it has been denied? or can this case get remanded and go as a TR case (non RIR)?
if anybody has faced something similar let me know... thanks!

On March 17, 2008, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before you get your new card call customer service. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
Eventhough I did not get notice yet by mail I am little confused and concerended with their message, I have couple of questions
1) Does this really means my AOS application is approved? Is there anything else I should do?
2) what is ADIT processing that they are referening to?
Any thoughts or experiences from the gurus here is really appreciated.

I worked for an employer on h1b from oct,2005 to jun, 2007 and then for another employer from jun, 2007 till now (Aug, 2009). My I797 says my H1b is valid only till 05/2010. Since i wud complete my 5years in US only in Oct, 2010, is it possible for me to get H1 extension for another year in 05/2010 even if my employer doesn't file for GC or he starts GC now but I don't get I140 by 05/2010. How and when do I need to apply for H1B extension.

For adjustee's AP gives permission to travel out-in. I think it should be ok to travel (you can subscribe to case updates and you'll know the case status)
