Please I need advice. I am currently preparing to file I-140/I-485 concurrent application and do not want to include the names of my children who are US citizens on the application. This is because I do not want the name of their mom to come up since I don't want to add her name too to the application. Although we got married outside the US, and I mistakenly wrote that with her name on my B1/B2 application I still will want to file this application as single. She has some issues to clear with USCIS and I do not want to complicate matters by adding her name to my application. I truly will appreciate your advice on this matter before I submit my application. Thank you

I have a question regarding dependants. I have a L1A Visa. I am going on a long trip to UK next month. Can my dependants stay back for 2 -3 months before joining me in UK. Their L 2 Visa and I 94 are valid till Feb 2009.

Hi,
I have been working with a company ABC from April 2007 in India. In Oct 2007 I got my H1B visa stamped for a company XYZ of USA and is valid thru OCT 2010. I took a long vacation here in India and went to USA for the company XYZ and stayed there for 45 days. During the period of stay I got my SSN and also I got one payslip generated for two weeks. Becoz of the market slowdown I had to return back to India and joined the same company ABC in India. Now this company ABC wants to process B1 for me, So is there any problem if I have to apply for B1 and is there any problem in the Embassy about the 45 days I spent in US on H1B while I was employed in a company ABC from April 2007?
Please suggest me on this asap

Make a new year resolution that has positive impact on your life style. :D
I personally will try to loose 10 pounds, Switch from Beer/Scotch to Wine (can't gaurantee leaving scotch :p and will do some certifications and keep bright faces of my kids and my wife always in front of me and in my mind if I do get discouraged.

Hi,
I am here in US working for a company on L1 Visa. My Visa and I-94 expires on November 2010. The company has already applied for my H1. I am planning for a vacation to India in August. I have the following question,
1. When I comes back to US from my vacation, in September, I dont have to go to the consulate, as my L1 is still valid. And I wont be able to go to the consulate for H1 stamping, as they wouldnt have started the stamping for this year, right?
2. Once I am back in L1, do I have to go back to India for H1 stamping, as my L1 expires in November?
3. Or the best method is to visit India after October and get it stamped with H1 from the consulate while coming back from India?

I was scheduled for Infopass today and found out the alien number assigned to my I-485 application is not the one mentioned in I-140 and belongs to somebody else in florida. I called NSC and they processed the service request and told me to wait for 45 days. I talked to NSC directly and without checking my application details, the officer tried to assure me that it is something that they will be able to fix when they will adjudicate my case. My EAD and fingerprinting were cleared under the wrong alien number and my lawyer told me that the alien number is assigned by USCIS. I will check my documents to find out if they did that mistake.
Anyone else got in similar situation or know about someone with the same issue?

I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

Financial terms were not disclosed, but a publishing official with knowledge of the negotiations said Monday that the agreement was comparable to the $8 million Sen. Hillary Rodham Clinton received for "Living History" and the $9 million former British Prime Minister Tony Blair will reportedly get for his planned memoir. The official spoke on the condition of anonymity, following standard industry practice.
"I've been fortunate in my life to grow up in an extraordinary family and to have a front row seat at many key events in our nation's history," Kennedy, 75, said in a statement. "I hope my reflections can contribute to a deeper understanding of many events in the history of this great country and to a more in-depth picture of an American family."
Hachette's acquisition came after a six-day auction involving nine publishers. Kennedy was represented by Washington attorney Robert Barnett, whose other clients include Clinton and Tony Blair.
The book, currently untitled and tentatively scheduled to come out in 2010, builds upon the oral history project that Kennedy has been working on through the Miller Center of the University of Virginia. The project, launched in 2004 and expected to last several years, will include interviews with the senator, family members, colleagues, journalists, foreign leaders and others.
For his memoir, Kennedy plans to use a co-author/researcher, still to be determined. A "significant" portion of the proceeds will be donated to charity, including the John F. Kennedy Library, where the senator's public and private papers will eventually be stored, according to Kennedy adviser Stephanie Cutter.
The book will be published by the Hachette imprint Twelve, founded two years ago by former Random House editor Jonathan Karp
"The senator's book is not about the money," Karp told The Associated Press. "I think it's about telling a story that only he can tell. He's both seen history and he's made history. His perspective is unique, and it would be a tremendous loss if he did not put his experiences in writing."
Karp said that he and other Hachette officials went down to Washington last fall to meet with the senator at his home, where they talked in Kennedy's study, family pictures on the walls, books by Robert Caro and David McCullough on the shelves.
"He intends to be candid," Karp said. "He's a great raconteur and he talked so articulately and disarmingly about his childhood and some of his political experiences over the years that you got the sense that this is a man capable of captivating anyone with a story."
Kennedy, a Massachusetts Democrat and the youngest of nine children, was first elected to the Senate in 1962, when he was voted in to fill the seat initially vacated by his older brother, John F. Kennedy, who had been elected president. Ted Kennedy was just 30 at the time, barely old enough to legally have the job, and his greatest burden was living down the taunt of his Democratic primary opponent, Edward J. McCormack: "If your name was simply Edward Moore instead of Edward Moore Kennedy, your candidacy would be a joke."
Kennedy's achievements and troubles exceeded everyone's expectations. Brothers John F. Kennedy and Robert F. Kennedy were assassinated, and personal scandal � most notably a 1969 accident in which a car he drove ran off a bridge, killing passenger Mary Jo Kopechne � helped prevent Ted Kennedy from becoming president himself.
But he also emerged as one of the Senate's most accomplished and eloquent legislators, respected even by Republicans for his knowledge and hard work, and for his role in passing bills on education, wages, health care, immigration and many other issues. Last year, he was easily elected to his eighth full term and has no plans to retire, according to Cutter.

If I resign, If my employer cancels my I-140 and use that labor and PD for another person within next 3 months. Can I still use the same priority date if I reach to the I-140 stage in the next 9 months at the new employer?
I have a nice offer from a reputed company but am worried that my current employer (small-time consulting company) would revoke 140 for the purpose of substituting it...Otherwise they have no problem with me but then it is a business for them.
I asked them if it is not illegal/immoral to do that. Their reply was that it is illegal only to sell it and not if it is given away as a favor and they seem to have folks waiting on the sidelines...
I am waiting for that law to ban it but it does not seem to happen...
