In its press release, USCIS did not state how cases filed and rejected on the 2nd are to be handled other than to say that properly filed applications would be accepted. This presumably covers the many cases filed after the second that were held, but it doesn�t explain what will happen to the cases received earlier. We hope USCIS will issue special instructions to issue July 2nd receipt dates to those who are able to document they attempted to file. We presume some folks are still waiting on their July 2nd cases to be returned and are debating refiling new cases rather than waiting. Unfortunately, there is a risk of not getting the package back before August 17th and some people will need to refile without proof of the earlier filing. No more interim EAD at Infopass since Sept 2006.
If it's an emergency like loss of job offer etc. you can take a cover letter with your receipt notice to Infopass and they can fax it to the Service Center for expedited service. Alternatively you can fax it yourself.
The decision whether to expedite your case rests with the Service Center.
Also I would say hang on for a few days if possible. I got my EAD approval e-mail after 101 days since RD from NSC.

Hi all,
I have posted my case details but here it is again. I got a reject on my H1 after receiving 221(g) form. Same old reason cited in the letter. The case reached USCIS on 28th Jan and no progress after that.
My husband works for the same company and he got his visa stamped after 221(g). Now i am planning to apply for H4. I have a few questions.
1)Can i go for H4 stamping without revoking my earlier H1? Will i be asked to revoke my H1?
2)Since my husband works for the same firm and i got a reject working for the same firm, can my H4 be a problem?
3)Can it be a problem to my husband's H1 who got it stamped successfully and is already in the US?
4)My idea of not revoking H1 is because i want to try a COS once i am in US, which some people have done it successfully. But does anyone know if this has to be done before April, before the new H1B quota opens up?

Illegal non-immigrants did the rally to local USCIS offices. It would be good if we pick one day in 2nd week of July and have a rally to local USCIS offices. This will immediately catch the media attention.

The story of the new Congress is actually two stories. Democratic leaders and their grass-roots supporters will decide in the coming days which narrative will prevail.

Pelosi noted at a January news conference that so many Republicans voted for the Democratic proposals that one of her colleagues joked: "Maybe you made these bills too easy."
The Senate Democrats quickly pushed through a different version of the minimum-wage increase, and the party's leading foreign policy voices framed a critique of President Bush's Iraq policy that squared with the public's increasingly skeptical view of the war.
But recent weeks have held nothing but trouble for Democrats -- and it is odd, as one Democrat noted, that they should be on the defensive when the scandal over the treatment of wounded veterans at Walter Reed Army Medical Center has focused attention on yet another failed aspect of the administration's execution of the war and its aftermath.
Instead, one news story after another has highlighted differences among congressional Democrats over how to end the war. There is also the divide between the Washington party and activists at the grass roots and in the blogosphere. All of these problems are rooted in two unalterable facts: Democrats, on the basis of their thin majorities in Congress, lack the numbers to force an unwilling president to alter his course. And they are short of votes to cut off funds for the war altogether.
My Comments
Dems are not united on most issues.
Although this article is on Iraq, a similar situation will occur on Immigration. The big difference is that Dems are very interested in Iraq (they won elections on Iraq) whereas I haven't seen much much Democratic interest on Immigration.

Which comes first.....card production ordered or approval sent? Are there cases when they don't update the status online with "approval sent" yet you have physically received the EAD cards. How long does it take to physically receive the cards from the date the status changed to card production ordered?

Yes you can travel with H4 to US with your Wifes H1 and then transfer to H1 if its still vaild at the time of transfer.. Note you can also use your existing H1 as well, As per rule an H1 can be in the US for 6 years. if you have spent some time in between outside US that duration will not be counted in the 6 yrs. So calucate your exact number of days spent in US and if it exceds 6yrs then its not possible to use your existing H1. Note: the days spent on H4 will not be counted in 6 yrs but days spent on L1 will be counted.---

My sister filed 1-130 for me in 1997. I am currently living in the US on an H1B visa and the I-130 has been approved. As requested by the NVC, my sister submitted her affidavit of support (I-864) and paid the immigrant visa fee. However, I recently found out that I should have filed I-485 instead. I was advised that I cannot file the DS-230 because I live in the US. Is this true? Which could/should I do, DS-230 or I-485? Is there a way to get the immigrant visa fee returned?
I will appreciate any advice.

My employer is a single architect and owner of his sole proprietorship LLC firm and he filed an EB3 I-140 for me submitting the "Schedule-C" of his tax return, which shows a net profit of $57000 for the company. The prevailing wage for my architectural technician position is $35,100, and NSC is asking for my employer's personal financial documents, saying that they are not satisfied only with "Schedule-C" and �Net Profit� of his tax return and a sole-proprietor petitioner has to prove that he can sustain his household and the proffered wage. Can USCIS ask for personal finances when the net profit of the company is clearly greater than the prevailing wage? Has anyone been in the same situation? Any suggestions from the gurus?

yes, its normal and ok. Your 485 will be processed independently of your I-140, and your fingerprinting, namecheck etc will all keep happening. You just cant get it approved without getting the I-140 approved first. Everything else goes on in parallel.

I am seeing people with july 2nd dates getting their checks cashed, and there maybe a quick jump after July 2nd because of the bulletin fiasco we had. And plenty of people have filed after July 17, Could someone tell me if their checks have got cashed? This could be a helpful thread for After 17th filers.

You may be able to stay without a job as long as the future job offer is still open and the gc sponsoring employer has an intent to hire you after the 485 is approved. Please confirm with your immig attny

only the photo-copies of all the documents they mentioned, each page notarized.
