Hi,
Based on what I know, the medical exam has to be less than 1 year old on the date of I-485 application submission. However, I have seen different opinions on this forum. Some state that the exam date cannot be more than 30 days before I-485 submission, because the HIV test and syphyllis test (sorry if not typed correctly) are valid for 30 days only. Could anyone clarify this, please?

i have it on Nikon mount, and one of the samples i tested had a back focus issue. i just bought the one that didnt. Sigma is real good at fixing/replacing defective lenses

Hi,
Need some help here for my friend.
He is an employee of company A and his first 3 yrs H1 is ended say Sep
25, 2009. But he was already got a new H1 approved 1 month back from
company B and that company had assured him to take him on board from
Sep 26, 2009. So he and his wife had both approved H1/H4 from Company
B. Now last minute the company B backed off from their agreement.
So he went back to his company A and asked for H1 extension on Sept
24, 2009 and for which they filed papers. But they didn't file papers
for his wife's H4. Can she be on company B's approved H4? if not how
many days she has to file for H4 linked to company A.

My 6 yr H1B is expiring within 4 months, my company will be filing for the 7th yr extension. Will there be any problem if I send my inlaws for visitor visa now.

Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

My priority date will become current on June 1st 2011. I will add my wife to green card process on June 1st 2011 (she is in US in H-4 status now). My I-485 is with Texas processing Center.
If I leave my sponsoring (green card) employer after 3-4 months of getting my green card and join another employer or have my own company, does it affect my wife's green card that may be still in process

On May 1, 2006, hundreds of thousands of immigrants around the country demonstrated against a restrictive immigration bill introduced in Congress. This weekend, similar demonstrations will occur around the US. I'll be attending my 20th law school reunion in Chicago this weekend and am hoping to attend that rally. I'd really rather be at the one in Phoenix and look forward to hearing reports from there.

If you have a phd, is it automatically EB1? or do the rules of employment should call for phd apply?

Hello,
Just wanted to update everybody on this. We went for renewal this morning. Took EAD, Passports and Original 485 receipts with us. When we showed our EADs the lady asked her sup, that these guys have EADs do they need anything else. Sup said with EADs nothing is needed. No Passports, No 485 receipts not even Employer letter. They renewed licenses till validity of EAD. We had 2 year EAD. So we are all set till mid of next year.

Hi - I am currently on an L1 blanket visa and it looks like my company will sell the unit I work for in the US. The parent company will sell the US division - I am currently in the process of applying for my GC - with the I40, and I485 both pending. I had my biometrics done today.
Want to gain some views on what my options are if the GC route does not pan out. I am on a UK passport, and would like to remain in the states. The GC is an employment based application - which is apparently quick, but I want to have a plan B. Is the next best option the H1B, and if so, will I be able to apply for this (if needs be) inside the US with another company if they are prepared to take me on?

WASHINGTON - California voters continue to disapprove of Congress even more than they do of President Bush, and for the first time Speaker Nancy Pelosi's ratings are more negative than positive, according to a Field Poll released today.
The poll found that 22 percent of state voters approve of Congress' job performance, with 64 percent disapproving. The discontent was bipartisan, with 70 percent of Republicans, 63 percent of independents and 58 percent of Democrats giving Congress negative marks.
Those findings, taken in a survey of 1,201 voters from Oct. 11 through Oct. 21, track national surveys. A Los Angeles Times/Bloomberg poll during the same period also found a 22 percent approval rating for Congress. A CBS Poll registered a 27 percent approval rating.
Bush earned a 27 percent approval rating from voters in the same Field Poll.
Political analysts give several reasons for the low marks: Democratic voters' dissatisfaction over the inability to change Iraq war policy, Republicans' opposition to Pelosi and other Democratic leaders, and a sense by many voters that Congress can't come to grips with tough issues such as immigration.
"Republican reaction has remained about the same this year, but the real trend is that rank-and-file Democrats and non-partisans are displeased because they expected more from the Democratic Congress," said Mark DiCamillo, director of the Field Poll.
Pelosi, a San Francisco Democrat, earned a 48 percent approval rating in March, two months after Democrats took over Congress. That dropped to 39 percent in August and 35 percent in October, with 40 percent disapproving and 25 percent registering no opinion.
"Iraq is the anchor weighing down Bush," DiCamillo said, "and now it's an anchor on Pelosi because of the complete inability of Congress to change course on the war."
Pelosi and other Democratic leaders held meetings in the last week to find ways to improve their "message" about what they call the New Direction Congress, highlighting such legislation as the minimum wage increase and ethics reform.
Despite the low marks for Congress, Republicans had little to cheer about in the new Field Poll. Voters gave an approval rating of 34 percent to Democrats in Congress, and 20 percent to Republicans.
Only 29 percent of Republican voters in California approved of the GOP performance in Congress, with 53 percent registering disapproval.
"That 2-to-1 disapproval by their own party really jumps out," DiCamillo said. "Republicans in Congress are now playing 'prevent defense' for Bush on the war and on domestic issues, and Republicans in this state do not approve of that."
The state's two senators, Democrats Dianne Feinstein and Barbara Boxer, earned higher marks than Pelosi and Congress overall, but the approval ratings for each senator dropped 10 percentage points since March.
The survey showed that 51 percent of all voters approved of Feinstein's job, with 31 percent disapproving. Boxer's approval rating was 44 percent positive and 35 percent negative.

I have done so and did not find any additional issues as compared to H1 upto I140 approval.

Can anyone suggest if there is a way to check the priority date on a I-485 application after an interfile request has been made? I am not sure if a call to the Service Center is the only way, or if there is a form I can submit requesting this information.
The context of my question is this: My original I-485 application was filed based on a LC/I-140 approved by PERM with PD May 2005. But later, as part of backlog elimination, an older LC for me with PD Aug 2004 was cleared and my company's immigration law firm got another I-140 approved based on this earlier LC. They've told me that they contacted USCIS with a request to get my I-485 attached to the older PD. I would like to get this confirmed since a 9 month gap in PDs can easily translate to years more of waiting time.
