For any effort towards making this happen. This will be a huge benefit for those of us who missed the July 2007 lottery. The only AC21 rejection that I've personally known is of a guy who quit after getting his EAD and started a business: consulting business to be PC. Made himself the "Chief Architect" and CIS said that his job description does not in anyway match his PERM application.

Why is the December visa bulletin not available on the USCIS website ?? It still shows November as the current bulletin.

If some one has applied for labor substitution for a better PD and I-140 a week back and wants to now file I-485 without the I-140 reciept. I guess the advise was that one can go for it. The question now is as the I-140 was filed a couple of days back does he need to provide the employment letter which in this substitution case is difficult unless the new substitution employer is willing to give. In such scenario can one file I-485 with out the employment letter.

but if I applied for I485 in July, and 485 applications they receive exceeds the visa numbers available for July, what happens? Do they draw lottery to see which 485 apps would be cosidered?

There are uglier things than sausages being made. For example, when Bernie Sanders gave a 30 minute speech to increase H1B fees and make H1B program useless, he brought a big chart and the whole enchilada to try to prove that H1B depresses wages.
However, in the starting part of his speech, he said he supports the bill.
The bill brings in 200,000 guest-workers each year (it was 400,000 before Bingaman amendment). However, according to him, that is just fine. When guest-workers come to US in numbers like 200,000 then they dont depress wages of the lowest income group in America. However, when hi-tech workers come here they depress wages.

I'm a South Indian and I have never had issues with Hindi or Hindi-speaking people. In fact, many of my friends are Hindi-speaking and I'm quite well-versed with the language as well (why not?). You cannot make a blanket statement saying that everyone speaking a particular language is rude or has bad attitude. Just goes to show one's ignorance.
Just look around and see what's keeping this country together? You can move from NY to LA without having to think twice. Try doing that back home ;)

Based on the reply to this FOIA from Needhelp!, it seems that we have a bigger problem than transparency.
They have said that country of chargeability is not assigned until case is ready for approval. However, whether or not a case is ready for approval is determined by country of chargeability. If you have 500,000 pending cases and dont know how many cases for each country of chargeability, then the only way to respond to a visa bulletin is to go thru all 500,000 cases every month, take a peek in it, look at the PD, look at the country and see if it is up for approval. I dont think they are doing that.
Also, if priority date is something that is different for different countries, then cases for those countries have to be sorted by priority date in different silos, so that when the next bulletin comes, you know how many cases are eligible that month and which ones are the earliest cases (from PD perspective) for each country.
Their systems are not designed for country chargeability and priority date considerations. Although some of the information is in computer systems for reporting, publication, online status, automatic emails, etc, most of it is paper based. They claim that they process cases in order they (physically) receive them at each processing center.
Possibly, what they do is that they pick cases from shelves in sequence they stacked when they received them, check various docs such as medical, birth certificates, copie of I-140, passports, etc., and then, if all ok, check for country of chargeability. If that is India or China, then they look at the current bulletin dates. If case is within cutoff dates, proceed, else put it back, and take next file.
Therefore, they are correct in saying that chargeability is determined (means: looked at) when case is ready (meaning: it is next in line) for reviewing and adjudication.
Note that there is no physical file sorting based on chargeability/PD etc. Bulletins are just best guesses based on general progress in preceding months.

I am EB-3 ROW PD 2007 Aug. Reading all the Eb-3 I people's angry, I started to wonder what's gonna happen to the EB-3 ROW. Seems like if lots of Eb3-I change to EB2-I , They will probably eat up all the Spillover from Eb1, EB2 ROW from now on. That makes EB-3 ROW and EB-3 I become the same boat.
Is it what gonna happened?
All Indians and Chinese will file only EB2 now onwards:D
The problem is with past filings how to convert them to EB2.

prince_charming, you had mentioned that you had done H1 transfer with AC21.
I think it was mentioned in one of the posts in Murthy site that such a situation could lead to denial of I-485 as it would constitute abandonment of AOS application. One should use EAD after filling AC21.

I recently talked with my lawyer and also took consulting (paid $$$ for hourly consulting) with another lawyer as I am going thru the same route. Both the attorney mentioned there was no problem doing ac21 for H1 while AOS was pending for > 180 days and 140 approved .

Thanks. I do have my EAD. Just fearful that since I wont be at the 6 month period, I wont get to portability.
Does US immigration check up on this stuff? If so, how? I'm thinking that the Texas processing center (where my info is being processed) is too busy working on my papers (and other folks' papers) rather than inquiring about everyone's employment status.

I just called the Lamar Smith's office and when I asked to speak with a person who handles immigration matters, the lady asked me if I am calling in support of Lofgren bills or not. When I said YES, she asked me where I am calling from. Nothing more. She know all the bills no. Its so simple.
All they are doing now is counting how many people are calling in support of the bill. So its time to call as many people as we can.
