Gautam: If you have difference with Immigration Voice's position in opposing the merits based system that gives 21 points being illegal and 20 points for having MBA or MD, then you are entitled to have that opinion, but dont peddle your agenda on this site and find another website or forum to advocate in favor of merits based points system.
Merits based point system awards supplemental points for illegals. Being illegal is not an accomplishment. Having an MBA or MD is. The two cannot be awarded merits on the same scale.
Merits based point system works well in countries that dont have annual caps. Like Canada. Their objective in Canada is to fill the country with younger working population in order to balance to demograph that is headed to an aging population. USA is not like that and having points system in conjunction with numerical caps will cause greencard to go to paper-tiger resumes that have lots of points but not employable. There are millions of Ph.Ds in Science in India and China and they would not be employable here but would get GCs. Just like Canada, we would have greencard holders with Ph.Ds and MBBS driving cabs. Employability has nothing to do with papers that prove how many years you spend on colleges accumalating degrees.
A bachelor's degree from Harvard and a Bachelor's degree from Rutgers would get same points : 16 points. Is that really a measure of merits?
But again, if you feel that point system is great, issue press release on your own and peddle your agenda on your own but dont use this site to peddle that agenda. You are free to discuss with other members but dont issue press release and dont speak to the media on behalf of IV. Speak to the media as an individual.

sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(

2. Make sure ead is extended without any rfe. Uscis will invent thousand things to issue rfe, ead should be in a different league to h1 and it should not turn into another h1 where you are slapped with rfe left right and center. Example pay stub rfe, ability to pay RFE, customer purchase order RFE etc etc etc, green card holders don’t have any problem working in these same jobs so why should ead people face this nonsense (otherwise it is just like h1).

sorry to hear about your new issue. Your case can be easily fought back, cheer up. My case was AC 21 and fortunately my I 485 was approved last month without any RFE, but before approval I spoke to NSC customer service and got hold off a very good guy , who happened to be very helpful, he mentioned that the letter requesting to port the employer or change of attorney need to be addressed to appropriate division, failure to do will cause all these problems, since it take time for the USCIS to route the letter to correct division and most likely getting lost. The only solution to address this kind of problem is to bring the much needed regulation to AC 21 , a formal application process where we can track the progress.

I never understood until this point how come a letter requesting to port job using AC 21 in most cases never reach the file, whereas the letter requesting to revoke I 140 from employers are getting processed in 99% of the case. maybe its an excuse to get rid of some of the backlog :confused::confused:

We can try but I have seen that it is not easy. I have tried calling a few friends but it is so hard to convince that the money is only going to help your cause. They will come up with every reason in the book to end the discussion. I am not saying that we should not try but you cannot help someone who doesn’t wants to get helped. We will need something more innovative. I don’t have the answer to what it can be but we have to keep on trying.

My experience is that whether an attorney is good or bad depends on the size of the sponsoring company. My boyfriend was working for a big company and got a really great service with Ogletree Deakins who have offices all over the US. When I was experiencing problems with my attorney, he highly recommended Ogletree and my employer contacted them, and our experience was really bad - they promised a lot of things, then realized it was a small company and was not so interested anymore.
That's why after LC got approved, we decided to file everything pro-se. We have had 3 different attorneys. My case started in 2001 and got stuck in BEC and a PERM case was filed to try to capture my PD from 01, and by looking at my signature you can guess what happened. So, lots of experience with attorneys, not one that could recommend.

Supporting skilled EB immigrants (140k per year, who will not be able to vote for at least next five years) or FB immigrants (860k per year, who may also not be able to vote for next five years) or no immigrants (join the part of Loo Doggs and count on may be 1-2 percent of population who may support them which would be 3-6 million votes).
In nutshell, from the perspecitive of politicians, it is never a good deal to support EB immigration; the only incentive for them is the money they get from big companies like microsoft, IBM, google etc. And this is not enough to land us anywhere. Only a very few politician (like sen Lofgren) work for their principles, rest is all vote bank; that's why horses are more important than us.
I am a little bit bitter here, but it is time to understand this reality and consider our strategy accordingly; espeicially for the possible CIR next year.

guys, we got fooled twice with this CIR, I just can't take these rollercoaster drive any more,
WE need to learn lesson from this exercise is that being part of illegals only gives us wrong end of the stick,
let's try to spend our money and energy ONLY for us not to reform any major law, not increase H1B qouta and not to exempt anyone,
