    I'm in the 8th year of H1-B, BEC priority date 04/2001, just got a notice that the case was closed ?? and the lawyer is working to reopen the case.

    I have now a very good opportunity to work for another company, huge pay and benefits, a lot of pressure from this company to work for them.

    Pls who can answer 2 small questions:
    1. Do I have a chance to work for this company?
    2. It makes a difference if I'm currently in NJ and this new company is in Utah - thinking that maybe they are not so many applicants in that state? Just for the LC processing speed?

    Hi,

    Following is my visa status:
    Working for company A on L1B visa which has expired and
    1) L1 extension got approved from company A valid through Aug, 2010.
    2) Also have Consular-H1B petition from same Company A valid till Aug, 2011.
    No H1B visa stamp

    Following are my questions:

    1) I am sure, in my case i can transfer my H1B petition to company B with Consulor appointment. Needed confirmation

    2) As soon as i get laid off from company A, can i immediately apply for H1B peition transfer to Company B with Change of Status (COS)? how much time i have before my L1 gets deactived?

    I just read on other forums that no FP is required if EAD renewal is efiled. Only first time efile requires FP is this true?

    So far twice I have paper filed EAD. Now its time for extension. If I e-file will I get FP??

    Hi,
    I got H1-B petition (I-797) approved in 2008 but due to recession, I couldn't appear to consulate office. I did not get a chance to work in US for that employer so I don't have any pay stubs for that employer.

    The petition is approved till 2011. And now I am planing to either appear for visa stamping or transfering I-797 to any other sponser.

    My queries are -
    A-Appearing for Visa stamping now after long time is right option or is there any chance of rejection?

    B-Since My current employer is not able to employ me there,I want to transfer my I-797. Can It be possible? How much risk is there? If it can be done that what is the process of that please?

    C-Since petition is valid till 2011, If I get stamped this year Oct / 2010 what will be duration of visa?

    D-Any sponsrs list ?

    I saw soft LUDs on all our applications at NSC (pending 485s, 131s and approved 765s) on 12/12 and 12/15. This should mean some sort of system update on NSC, is it ? or should I look forward to good/bad news :confused: ? My PD is nowhere close to the current cut off date for EB2-I.

    Alan Brinkley is the Allan Nevins professor of history and the provost at Columbia University.

    Few people would dispute that the politics of Washington are as polarized today as they have been in decades. The question Ronald Brownstein poses in this provocative book is whether what he calls “extreme partisanship” is simply a result of the tactics of recent party leaders, or whether it is an enduring product of a systemic change in the structure and behavior of the political world. Brownstein, formerly the chief political correspondent for The Los Angeles Times and now the political director of the Atlantic Media Company, gives considerable credence to both explanations. But the most important part of “The Second Civil War” — and the most debatable — is his claim that the current political climate is the logical, perhaps even inevitable, result of a structural change that stretched over a generation.

    A half-century ago, Brownstein says, the two parties looked very different from how they appear today. The Democratic Party was a motley combination of the conservative white South; workers in the industrial North as well as African-Americans and other minorities; and cosmopolitan liberals in the major cities of the East and West Coasts. Republicans dominated the suburbs, the business world, the farm belt and traditional elites. But the constituencies of both parties were sufficiently diverse, both demographically and ideologically, to mute the differences between them. There were enough liberals in the Republican Party, and enough conservatives among the Democrats, to require continual negotiation and compromise and to permit either party to help shape policy and to be competitive in most elections. Brownstein calls this “the Age of Bargaining,” and while he concedes that this era helped prevent bold decisions (like confronting racial discrimination), he clearly prefers it to the fractious world that followed.

    The turbulent politics of the 1960s and ’70s introduced newly ideological perspectives to the two major parties and inaugurated what Brownstein calls “the great sorting out” — a movement of politicians and voters into two ideological camps, one dominated by an intensified conservatism and the other by an aggressive liberalism. By the end of the 1970s, he argues, the Republican Party was no longer a broad coalition but a party dominated by its most conservative voices; the Democratic Party had become a more consistently liberal force, and had similarly banished many of its dissenting voices. Some scholars and critics of American politics in the 1950s had called for exactly such a change, insisting that clear ideological differences would give voters a real choice and thus a greater role in the democratic process. But to Brownstein, the “sorting out” was a catastrophe that led directly to the meanspirited, take-no-prisoners partisanship of today.

    There is considerable truth in this story. But the transformation of American politics that he describes was the product of more extensive forces than he allows and has been, at least so far, less profound than he claims. Brownstein correctly cites the Democrats’ embrace of the civil rights movement as a catalyst for partisan change — moving the white South solidly into the Republican Party and shifting it farther to the right, while pushing the Democrats farther to the left. But he offers few other explanations for “the great sorting out” beyond the preferences and behavior of party leaders. A more persuasive explanation would have to include other large social changes: the enormous shift of population into the Sun Belt over the last several decades; the new immigration and the dramatic increase it created in ethnic minorities within the electorate; the escalation of economic inequality, beginning in the 1970s, which raised the expectations of the wealthy and the anxiety of lower-middle-class and working-class people (an anxiety conservatives used to gain support for lowering taxes and attacking government); the end of the cold war and the emergence of a much less stable international system; and perhaps most of all, the movement of much of the political center out of the party system altogether and into the largest single category of voters — independents. Voters may not have changed their ideology very much. Most evidence suggests that a majority of Americans remain relatively moderate and pragmatic. But many have lost interest, and confidence, in the political system and the government, leaving the most fervent party loyalists with greatly increased influence on the choice of candidates and policies.

    Brownstein skillfully and convincingly recounts the process by which the conservative movement gained control of the Republican Party and its Congressional delegation. He is especially deft at identifying the institutional and procedural tools that the most conservative wing of the party used after 2000 both to vanquish Republican moderates and to limit the ability of the Democratic minority to participate meaningfully in the legislative process. He is less successful (and somewhat halfhearted) in making the case for a comparable ideological homogeneity among the Democrats, as becomes clear in the book’s opening passage. Brownstein appropriately cites the former House Republican leader Tom DeLay’s farewell speech in 2006 as a sign of his party’s recent strategy. DeLay ridiculed those who complained about “bitter, divisive partisan rancor.” Partisanship, he stated, “is not a symptom of democracy’s weakness but of its health and its strength.”

    But making the same argument about a similar dogmatism and zealotry among Democrats is a considerable stretch. To make this case, Brownstein cites not an elected official (let alone a Congressional leader), but the readers of the Daily Kos, a popular left-wing/libertarian Web site that promotes what Brownstein calls “a scorched-earth opposition to the G.O.P.” According to him, “DeLay and the Democratic Internet activists ... each sought to reconfigure their political party to the same specifications — as a warrior party that would commit to opposing the other side with every conceivable means at its disposal.” The Kos is a significant force, and some leading Democrats have attended its yearly conventions. But few party leaders share the most extreme views of Kos supporters, and even fewer embrace their “passionate partisanship.” Many Democrats might wish that their party leaders would emulate the aggressively partisan style of the Republican right. But it would be hard to argue that they have come even remotely close to the ideological purity of their conservative counterparts. More often, they have seemed cowed and timorous in the face of Republican discipline, and have over time themselves moved increasingly rightward; their recapture of Congress has so far appeared to have emboldened them only modestly.

    There is no definitive answer to the question of whether the current level of polarization is the inevitable result of long-term systemic changes, or whether it is a transitory product of a particular political moment. But much of this so-called age of extreme partisanship has looked very much like Brownstein’s “Age of Bargaining.” Ronald Reagan, the great hero of the right and a much more effective spokesman for its views than President Bush, certainly oversaw a significant shift in the ideology and policy of the Republican Party. But through much of his presidency, both he and the Congressional Republicans displayed considerable pragmatism, engaged in negotiation with their opponents and accepted many compromises. Bill Clinton, bedeviled though he was by partisan fury, was a master of compromise and negotiation — and of co-opting and transforming the views of his adversaries. Only under George W. Bush — through a combination of his control of both houses of Congress, his own inflexibility and the post-9/11 climate — did extreme partisanship manage to dominate the agenda. Given the apparent failure of this project, it seems unlikely that a new president, whether Democrat or Republican, will be able to recreate the dispiriting political world of the last seven years.

    1. My 140 is filed and pending. I did not go through premium

    2. How to get the CP appointment?

    3. Since we dont file 485 if we prefer CP, what happens if the visa dates retrogress,but you have a CP appointment?

    4. Is there a way to secure something in CP while the dates are current. ie, in AOS, just filing is enough to avoid several hassles. Is there anything like this in CP.

    Need advice ...I am currently on H1 B.
    six years back (on F-1) I started working 2 business days prior to my CPT started.... Unfortunately ... that meant I did work unauthorized for a couple of days. Now I am at a stage where I need to use CPT experience to apply for PERM. Would stating the actual start date on form 9089 (which happens to be 2 days prior to actual CPT start date listed on I 20) pose any future issues?
    CAn I be granted lineancy (something like 245K) if in in future this lapse becomes evident to U S C I S. How seriously would this minor violation be treated?

    Mercury News ran an article today about H1-B Visas and mentioned that "Rep. John Shadegg, a Republican from Arizona, [was] planning to introduce a bill this week or next that would nearly double the number of H-1B visas".

    Does anyone know anything about it and does it include EB provisions, as well?

    Hi,
    Need good advice.

    My fiancee had an approved post decision status on her H1B application. She's waiting for an interview in the US Embassy for final approval.

    We're planning to get married so that she can bring me and our 2 year old son.

    My concern is what will we do, will we marry before her interview or after her interview?

    Another biggest concern is I have a pending petition from my mother who is US Citizen, I belong to F1 Category. I know that if we'll get married my petition will move to another category which is F3.

    So this is a bit confusing whether we will marry before her interview or after her interview?

    Please put some inputs. Thank you very much!

    If you go to the USCIS website (www.uscis.gov) you can download the EAD application and the list of documents that you are required to submit. My understanding is that the location where you file your EAD is dependent on the State where you live. The EAd application instructions include information on where to file depending on the State where you live.

    I have an approved labor and I-140 (EB2) with a PD of Aug 03, since USCIS guideline says that the demand for EB2 India seems to exceed the supply of GCs, I am not sure how much longer it will take for my PD to be current.

    My company has a approved labor (EB2) with PD of 2002 (with job requirements matching my qualifications). I have the following questions:


    1. Can I apply for premium processing for the I-140 stage with the substituted labor?

    2. If not, does it take longer to process I-140 with substituted labor than the normal case?

    3. if I can get the labor with 2002 PD, can my company give my labor to someone else (especially since my I-140 is already approved with that labor)

Is there an e-mail id that attorneys use to contact USCIS ? Offcourse, I could have asked my attorney, but I thought I would post the question here first.

    I changed my employer 3 months back and didn't expect the dates to get current so soon. My labor with the new employer has just been filed. However, my previous employer told me that if I want to continue with my gc process with them, I need to be their employee again.
    Does it make sense for me to do this ? My 485 will not get filed until 10 days from now because I have yet to start with the paperwork.
    Will the dates retrogress by then? Please advise me folks.

    The differences between House Speaker Nancy Pelosi and her predecessor, J. Dennis Hastert, could not be more striking.

    He is a burly former wrestling coach, a conservative Republican from small-town Illinois who usually ran from the microphones. She is the designer-clad member of a political family, a wealthy liberal from San Francisco who sees herself as a top party spokeswoman.

    But what could turn out to be their defining contrast was exhibited on May 24, when Ms. Pelosi allowed the Iraq war spending bill to clear the House with predominantly Republican votes while most Democrats � including her � opposed it. It was a marked departure from the principle that guided Mr. Hastert during his years as speaker.

    Mr. Hastert was an advocate of governing the House by a �majority of the majority� � a standard he thought best served the interests of his Republican members and, by extension, the nation. Just months into her tenure, Ms. Pelosi has shown she will deviate from that approach, balancing the potential of significant rewards against big risks.

    The rewards could come from success in winning approval of major legislation that reaches beyond party label. Critics of Mr. Hastert said his self-imposed rule prevented the House from considering centrist social and economic measures that, in their view, could have benefited both parties. It is likely, for instance, that a coalition existed in the House last year to pass an immigration overhaul that Republicans and Democrats could have hailed going into the elections. But strong opposition from a majority of the majority derailed that idea.

    The risks are related to party cohesion. If a leader such as Ms. Pelosi regularly cuts against the wishes of most of the people who put her in leadership, it stands to reason they would eventually wonder if new leadership was warranted. At a more subtle level, passing important bills with coalitions built outside party lines can expose and deepen fractures within them and sap the support of interest groups that can be essential to winning and holding onto power.

    Republicans see internal problems for Democrats as they sort through how to govern. �The problem for Pelosi is that the majority of her majority still has a minority mindset,� said John Feehery, a lobbyist who was an adviser to Mr. Hastert. �They would rather protest than legislate. And that dynamic will weaken her control over the House in the long-run."

    While some anti-war groups remain outraged at the war vote, many Democrats were not all that upset with the way she handled it. Through some procedural maneuvers, the speaker allowed Democrats to back a minimum wage increase and popular domestic spending and still vote against the war money. At the same time, Democrats got out of what the leadership saw as a political jam that could have left them being blamed for cutting off money to troops overseas.

    The next test for Ms. Pelosi will come on looming votes over increased free trade. Many - perhaps most - House Democrats are leery of going along with the push by President Bush, free-trading Democrats and congressional Republicans for new trade deals that they believe ship jobs out of the country and lack labor and environmental safeguards.

    To some veteran House Democrats, the 1993 North American Free Trade Agreement is a particularly bitter memory. A majority of then-minority Republicans joined with a minority of then-majority Democrats to pass the deal sought by President Bill Clinton. Quite a few Democrats believe that approval of the trade deal over the objections of organized labor diluted union support in 1994 and contributed to the loss of Congress by the Democrats that year. Ms. Pelosi was among 102 Democrats who backed the 1993 trade deal; 156 Democrats, including the majority leader and whip, opposed it.

    Anti-trade Democrats are worried the war vote foreshadowed Ms. Pelosi making a similar trade move this year, forgetting the hard lessons of NAFTA. They promise that such a decision will stir strong resentment. Ms. Pelosi has urged lawmakers not to jump to conclusions, but she is making no guarantees that legislation must have majority Democratic backing.

    I requested for a document that got returned as undeliverable to be resent.
    I first requested CSR and she gave me a referrral#.
    Same day I spoke with IIO and she made the request again for me(before I could tell her I spoke with CSR)

    Today I spoke with a CSR and gave her the referral# that the CSR gave me last week and this lady says she didn't find any information related to this referral# .She did say it does surprise her. She also said she will open a new request .

    I was concerned if that will be kind of duplication of the work done by CSR & IIO last week and she said there is no need for such concern.

    What does all this mean?
    They open a request , give you a referral# and tell you the document will get mailed in 3-5 business days .
    IIO says she has placed a request.
    You go back after a week , and referral# has no information attached to it and this CSR says she 'll open new request.

    Anybody has any idea?

    @Kirupa: Not live tiles, but selection tiles (thumbnails) -- square boxes with text and maybe an image . They are use in panoramic applications instead of a list box.

    You should do a video tutorial on creating the different elements of a panoramic app, i.e., the listbox, selection tiles (thumbnails), and a listbox with text+image(on the left). I think the xbox hub is a great example.

    My wife came to USA on H4 visa in January 2004. Later when she got a job, she changed that to H1B in September 2004. Since we do not yet have the EAD or green card, her company is now filing the Perm labor certifcation, to make sure that she gets the 7th year extension of H1B. The rule is that you should file the labor before the 6th year starts.
    My question is when does her 5th year ends. Was it on January 2009 based on her arrival in USA or is it on Sepetember 2009 sincw her H1B visa started only on Septemeber 2004?

    I think you should be ok as long as the I-140 isn't revoked. Green card is for future job and so you dont need to be currently working for them.

    Hi,
    I applied for fresh EAD I-765 in Jan 2011....it is still in initial review stage.
    M on L2 visa (dependant of L1)......and bcoz of some urgent reason ,here onwards i cant stay in US any more.

    So,
    1. Is there any provision for taking back application of I-765?(means i spent $380 for I-765,so can i get it return?)

    Plz ....i need suggestion as early as possible!!

    I have applied for EAD renewal on September 1 2010. I have received receipt notice and checks are cashed . There was soft LUD on my case two weeks back without any change in status . To day I got email with case status � Initial Review� with following messsage

    We have placed this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on hold because there is a pending litigation that may affect the outcome. We will resume processing as soon as the litigation is resolved. We will notify you by mail when we make a decision about your case, or if the office needs additional information.

    This is my 5th my EAD Renewal and earlier I do not have any issues with Renewals . My current EAD Expires in December 1 Week . Please advise what I need to in this case , as I do not have any clue about pending litigation. Can I check with Local office about what was the pending litigation or do I need to approach through lawyer

    My I-485 has been denied based on the fact that I entered the country illegally in 1985.

    My last USA entry was in 1998. It was a legal exit and entry. I was given a permit to make a trip to South America. Can the fact that my last entry was legal be enough to reopen the petition? Can I used my last entry as basis for my I-485 adjustment?

    Hi,

    I filed my EAD and AP renewal on Sept 17 (20 days) ago but still I haven't heard received neither receipt notice nor my check being cashed. Is there anything we can do to find out about the receipt notice? Fedex tracking shows the mail being already delivered. I am currently working on EAD and recently used AC21 to switch the company so EAD is very important to me.

    Please provide your feedback and if anyone is having same delays in getting receipt notice for EAD / AP.

    Hi,
    Am on H4 and applied for H1B in May 2006. Because of emergency, we need to travel out of US; got the approval on Sept 7th and returned to US on Sept 10th. I lost hopes of Change of Status petition approval(as one of my friend's COS petetion is rejected eventhough she didnot leave US during H1 process), but surprisingly when I received my papers today, it is approved with old I-94 number. Thank God.
    Now, Can I go ahead and apply for SSN. Can they ask me to go for stamping as the I-94 on the approval notice is different from the current I-94 in the passport?

    Hi All,

    Today I received an email from CRIS saying that they have sent me an RFE on my AP application. My wife's AP was approved last week, so it really confuses me about what this could be about? Can anyone shed more light on "probable" causes of I-131 RFE?

    I have another question - my passport is expiring in November 2007. Could that be the cause of the AP RFE? I could get that renewed from Indian embassy in 10 days, so its not a problem. But, has anyone heard about cases where expiring passport causes RFEs?
