I have an I-485 filed under EB2 category and have used the Advance Parole documents to travel outside US. As a result my I-94 states my status as "PAROLEE".

I recently got my EB1-I-140 (Extraordinary Ability) approved and my lawyer wanted me to apply for a new I-485 saying that transferring a I-485 gets rejected more often.

However, on knowing that my I-94 states that I am a Parolee she tells me that she cannot apply for a new I-485. Is that true?

Urgent response will be greatly appreciated.

Nikon's very competitive price point on the 10.2 MP D200 (http://www.dphoto.us/news/node/2003) ($1,849) will definitely test Canon's bet on the full frame and much more expensive 5D. You can only change the name on the visa by applying for a new visa. Since that is probably impractical and too much trouble, I recommend keeping the visa as is until you need a new one. If the name on your other documents is your married name, you can carry a copy of your marriage cert. to show the reason for the difference.

I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

My spouse H4 extension was filed in Jan 2011 and I was under impression that receipt is with lawyer. But recently I came to know that it should come to my address, as of today we have not got receipt no. I am still waiting for H1 approval decision and know H1 receipt no.

Is there way for us or our lawyer to get receipt no. for my spouse's H4 application?

as per my knowledge"One should file a new LCA for an H1B petition" if work location changed from one state of US to other state.

Can you please tell me the process and how long will it take for this LCA approval?
After LCA approval, do I have to go for Visa stamping though we have valid visa?
How much does it costs for new LCA?

My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!

However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.
