Hi
My fiancee is currently on H1B (got through the 2008 quota) and I am currently on F1 visa status. She is planning to go on an F2 as my dependent.
Please clarify these doubts:
When she gets a job while she is on F2 and the new employer processes her H1B does she have to go through the whole process of H1B as a new visa issue (annual cap) or is it like an H1B transfer?
Once going from H1B to F2, is there a certain time period one has to wait before one can go back to H1B?
If the F2 application is pending, is it possible to reapply from F2 back to H1B during that period?
Any help will be greatly appreciated.

your father can apply for visitor visa, but there are no guarnatees she will be approved. Even if he is approved and comes to the USA, applying for adjustment of status would be a mistake (entering as tourist while in fact intending to immigrate) and could lead to permanent bar. If he applys and is approved, she can come to visit and return to home country thats the better option.

Giving I-485 benefits to people without current PDs is a bad idea.
so what 's good idea to you......putting all of EB applicants who are waiting to file 485 in waiting state until you get your GC is a good idea?
First of all, why are you being worried about this action item being EB1 applicant and you will get your GC in no time...
I don't think you are from EB1 category...You are selfish mind who holds EAD and doesn't want other EB applicants to come in to 485 waiting line.
would you have had the same thought if there was no July 07 fiasco and if you would need to wait in the line........selfish minds like you can't stop this action item.

OFLC is working to rectify this situation immediately by identifying the affected cases, and reinstating them back to the appropriate processing status in proper order. This effort will be completed by November 30, 2006.
Although affected employers and their attorneys will NOT be receiving an additional notice of reinstatement, they may verify their case has been reinstated using the Public Disclosure System (PDS) starting December 1st. Since verification will be available online, employers and attorneys are requested not to contact the Backlog Elimination Centers regarding status.

Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.
We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.
