    Hi friends..


    I have question to all of you. I am the primary filer to I-485. My wife worked on EAD last six months. Now she is out of project. Planning to go india and come back after 6 months.

    Is there any problem, if stays more than 6 months out side country.?
    Some people scaring me.


    Please give me your suggestions.

    I resigned my job last year on Dec 15th 2006 by giving my employer a 2 weeks notice (dec 29th was supposed to be the last working day). A week later, i informed my employer that i won't be leaving them at which time, he suggested that i continue working as normal and that he would take care of un-doing the paper work. They had sent out a letter to INS to revoke my 797 even before my last working day with them. The HR contact has failed to follow-up and inform the INS of this development and am told last week that i have been out of status for 10 days now (March 10 was the day INS revoked my H1b). The company has accepted responsibility for this mess and are filing an accelerated H1b (premium) application this week. I had continued employment this whole time and never had any break in my payments. Are there any chances the INS won't put be back on H1 status with my company ?.
    Experts .. please advice.

    Hello,

    I was born in Canada and moved to the U.S. when I was 8 years old. I was naturalized when I was 18 (4 years ago). I heard that when naturalized in the U.S, my Canadian citizenship was not lost (I never filed any paperwork with the Canadian government stating I wanted to give up my Canadian citizenship either). Is this true?

    If so, can I apply for a Canadian passport? Should I do this? Are there any responsibilities/problems/repercussions that could occur if I do this?

    This is to humbly request you to guide me.

    I did AMIE in Computer Engg., from India and thereafter I underwent WES evaluation. It clearly stated that its equivalent to US Bachelors. On the same basis, I did my MBA from University of New Haven, CT USA. Now as I wan to file my H1B on the basis of my AMIE qualifiactions, what would be your wise advice?

    I applied an LC from an employer on March 27th 2005 (Pre-PERM)
    It is shifted to P-BEC. I have not got any 45 day letter for that
    How do I get the 45 day letter?

    This evening, news media outlets are reporting that Solicitor General Elena Kagan will be the nominee to replace Justice John Paul Stevens on the US Supreme Court. Kagan was asked last summer by the Supreme Court to opine on whether the high court should hear a challenge to the constitutionality of the 2007 Arizona employer immigration sanctions law. Kagan has so far not provided an answer and she'll no doubt be asked about this. She'll also likely be asked about the new Arizona law.

    I was working for company A in US till June 2008. I had to return to India in July 2008 due to personal reasons. My 6th yr on H1b expired in October 2008.

    I am now in India and applying for 3yrs H1b extension based on my approved I140 with company B. My I485 was filed in august 2007. I do not have US pay stubs since July 2008 as I did not work in US.

    Has anybody been in a similar situation? What are the chances of getting approval? Once I get I797 approval, should I expect further challenges in getting visa stamped in India?

    My father in law mistakenly entered the wrong date for his date of arrival in the U.S. (entered data in Indian style) on his citizenship application form. The number of days out of the country was also wrong.

    Is there a way to rectify this mistake and inform USCIS about this ? Is there a form, or can we simply write a letter regarding the errors to the USCIS office ?

    What would be the best way to address this issue ?

    I have an Indian passport and currently working in USA on L1B visa. Before leaving India I initiated the process of getting permanent residence visa from Australia and while I was in USA I got the AU Independent (Migrant) Visa (Subclass 175) visa approved and it was stamped on my passport by the AU embassy in Washington DC.

    My queries are:
    - I am planning to go for a vacation to India very soon. While returning to USA will it be a problem with my Indian passport having both USA L1B visa and AU migrant visa.
    - For the initial entry to AU, I want to go there next year only for a week directly from USA. Will it be a issue for me to enter the US in my return trip

    Your advice on this will be very helpful.

    I have worked for Company "A"(Ex-employer) under H1-B(company A holding my H1-b) from 2007-2010. During 2009 & 2010, company A was unable to clear all my payments as the company went through some financial hurdles but they issued W-2 for the amount paid in fiscal year 2009. Now, company A has got money and they decided to clear my back wages for 2009-2010 through 1099 form. I transferred my H1-B visa to Company B(2010) then to Company C(current employer). Now, Company C has started my Green card(GC) process.

    Questions:
    1. I already received W2 for 2009. Can company A amend the W2 for the back wages?
    2. Is it legal to take the unpaid amount under 1099? Will it affect my GC process?
    3. What are my options to get my back wages from company A?
    4. Company A want to issue 1099 along with a letter stating that i was full time employee for the time period mentioned in 1099. Is it acceptable?


    I really appreciate your help for taking your valuable time in clarifying my questions. I look forward for your reply.

    I am an EB3 (rest of the world) -
    My I485 has a receipt date of 7/24/2007.
    The processing date TSC is showing is 7/16/2007.

    When my date comes up inside the Processing dates range, will the category be relevant for the approval? I am asking this question because I have a friend that is an EB2 and a receipt date of Sept 2007, and got his GC on December 2007...
    If the categories are relevant, how can we monitor the process (the processing dates then become irrelevant)...

    Be very very careful.. There are lots of carcasses along the highway of pre-approved labor..
    In any case.. I have almost never seen this work when people enter it solely based on labor based logic, If every thing else is fine like project/attitude/salary and approved labor is add-on.. then you got lucky.. and Good Luck!
    But rule of thumb is .. if it's too good to be true.. mostly IT IS..

    I just spoke with Xiyun Yang from Washington Post and conveyed thanks for covering a detailed article. She expressed that there is attention being drawn by many quarters including political for "Skilled LEGAL Immigrants".

    Also we need to emphasize & communicate is the "increased fees" (almost doubled in many cases) for all USCIS services effective end of this month (July 30). Is this the penalty to be legal ?

    The rallys and campaigns should emphasize this important detail too. This is huge money and not fair to the amount of service that is being currently provided.
