USCIS reports that 1000 H-1Bs were receipted over the past week with 34,500 now counted. 400 masters cap cases were added bringing the total to 13,000 in that category. That's about on pace with the last several weeks and the exhaustion target in that category remains February 2011. My methodology is simple. I take a rolling average of usage over the last four weeks and then project out in how many weeks the quota will be used up if that pace continues. I know that the EAD card comes directly to the applicant and not to the attorney.
What about RFE on EAD? Does that too come directly to the applicant?

According to the mathew ohio website. there is apparently a very hot legal battle going on between the DHS and a happless immigrant who had been arested for out of status presence. The immigrant was on an H1b and had filed an application in a timely manner and was awaiting decision on his application when the DHS official arrested him and tried to deport him. Please post more information on this issue if anybody is aware of it. His I-94 expired, however, his petition for H1b extension was pending!!!!:o:o:o

Current Status: H1 (visa stamp expires Sept 2011)
Citizen-India
Current: Company A (Has filed for h1 extention on May 1 under normal processing)
Future: Company B (Has filed for Transfer under Premium Processing as of May 6)
Currently employed with A. Company B lawyer has filed a transfer on May 6 Premium Process.(I believe current status is LCA is under process).
I plan to resign on May 21 with A and travel abroad to Dubai On May 22. Will be back on June3 to usa
>Can i travel abroad even if my tranfer is under process
>When i enter, what documents do I need to show at POE?
> Can i enter with Company A visa stamp
>Any issues if current employer informs USCIS about my resignation?

A consultant in my project recently got his visa stamped in India. He didn't faced any issues. They didn't even ask for client letter. I guess he is just lucky :).

The annual Consumer Electronics Show kicks off this week in Las Vegas. This is the gadget wonderland I've attended for the last several years. Due to my father's illness, I decided to skip this year's show. But I'm avidly watching online for announcements of the year's best new innovations. The show is put on by the Consumer Electronics Association and they've recently launched "The Innovation Movement" which seeks to encourage public policies that foster innovation and promote prosperity. I came in on an F1 and got transfered to a H1B without leaving the country.
My H1 was approved for 3 years ie till 2012.
Due to problems at my work place, my H1 got revoked by my employer.
I'm in the medical profession, hence, jobs are few and far between if removed form a training program such as I was in. The next cycle of jobs dont start employment till July 2011.
I am currently within the 180 day limit.
What are my options? My countrys consulate is known to be tight fisted with visas, especially as I have overstayed since I lost my job abruptly.
If my fiance and I do get married, am I eligible for for adjustment of status?
Please help!

All,
Over the past few days we have been successful in getting good media attention BUT except for NYT, the coverage has not focused on the issues that are relevant and will draw the attention of the policymakers. I think the media drive should focus on getting the following issues highlighted:
1. Lapse in protocol when issuing green cards
a) Green cards issued WITHOUT security clearence
b) Green cards issued to those whose PD was NOT current in June
2. Obvious intent to NOT accept applications in July so that they can receive the same with a higher fee in the future. This at the cost of making a mockery of hundreds of thousand of hopeful legal immigrants
I think the media drive should focus and highlight the above and other key issues rather than merely reporting on the sequence of events. Please share your thoughts and add to the list above

You can only change the name on the visa by applying for a new visa. Since that is probably impractical and too much trouble, I recommend keeping the visa as is until you need a new one. If the name on your other documents is your married name, you can carry a copy of your marriage cert. to show the reason for the difference.
