I filed I-485 in Jan 2007 under EB-1 in Nebraska Service Center. Got finger-print, EAD, AP in April. No other status update after that. Online case registration shows LUD for April.
- Online processing dates show "Dec 19, 2006" for EB-1 I-485. Any idea when I should expect any updates ? What will be the next steps involved ?
- Any way to find out whether my application is sent to name-check ?
- Anyone else in the same boat ? If you filed around Jan/Feb 2007, please do reply back to this thread, or my email vinay.shah73@gmail.com

USCIS has released figures from the first week of the H-1B season and filings for the 65,000 H-1B "regular" cap slots for the fiscal year that begins in October were just 13,500. That is less than one third of the 42,000+ received during the same period last year and only about one-tenth of the number filed two years ago. Only 5,600 masters cap applications were filed against the 20,000 cap in that category.

Regarding coming back on F1 after being on H4... You should really consider talking to an attorney. With F1 visa you need to prove that you would come back to India at the time of stamping, but with your spouse being on H1 and in states.. how do you thing you can prove that you will come back to India when your spouse is in the states..

Hi All,
I am a bit concerned that my attorney wants to send the response to my RFE to the courier address for TSC rather than the po box listed on the gold sheet. Is this ok? Will the response reach the right place? They always use FedEx so they are saying that this is how they will send it.
People who had an EVL RFE on their 485 from TSC please respond.

Hello All,
My checks got deposited on Friday and when I checked my wife's I 485 status with the LIN # on the back of the check, it said that the finger printing fee was rejected and that the case is now in suspense.
It said that I have to submit a new fee and that the case will be resumed again.
Do you know why this happened. My bank statement says that the finger printing check for her got deposited.
So if there is a mistake in the check, would they still deposit it ? And would her EAD application get processed even if the finger printing fee is wrong ?
Did this happen for anyone ?

my wife and i went to renew our DLs.
i am on EAD and my wife is on AOS(pending 485) and we both have AP valid till feb 2010.
i got a temporary DL and will get 1 year DL in the mail.
my wife got temp DL but will get DL till feb 2010 only (expiration of AP-I94). they wanted to see I-140 or I-130 alongwith I-485.
i emailed flhsmv.gov and they also say that now you must show 140 and dependent names in 485 application which most of us dont have.

Hi, Im a pediatritian from Venezuela. I was hired by a research institution to work for a year here in the US, and i was granted a H1b non clinical Visa about 3 months ago. A month ago I was offered a position on the fellowship program of Pediatric Critical Care at the same institution but they need to change my visa to a Clinical H1b visa. I went to all the process here in the US. I havent go to Venezuela to get my passport stamped but at the International Depatment of the Institution they told me that i can Travel to Mexico or Canada for less than 30 days without my passport stamped, no problem. I have plans to go to Mexico for Christmas. Now my question is:
Can I travel to Mexico with my first H1b visa aprooval while my other H1b visa is on process?

All,
I wonder if more of you have noticed this phenomena: one of your applications gets approved, but the approval doesn't show up on the online case status system.
My AP was approved on Sept 17, 2007 and mailed out to my attorney who got it in a few days and told me about yesterday when I emailed about another issue. Oddly enough, even today (Sept 27), the online case status system shows an LUD of Sept 14 but no approval. I didn't get the usual approval email from the case status system either.
Annoying -- since now I won't learn of new developments till my lawyer calls me up to let me know and you know what slackers they can be. Although all this may be moot since apparently I am stuck waiting for my name check to clear, so there won't be any new developments to look look forward to for a long long time. Sigh. :(

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.
Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?
3. If I was to apply for H1 extension in Nov and don't get an approval by the time of my current H1 expiry in December, will I be out of status?

On July 9, the Senate, by a vote of 84 to 6, passed a DHS funding bill which includes a variety of immigration enforcement and benefits measures. The measure now goes to a House-Senate Conference Committee which must reconcile this bill with a funding measure previously passed by the House of Representatives which contains none of the immigration amendments added by the Senate. yes. its possible. i had my 140 denied and i wanted to know everything about my case from labor to 140denial to appeals. I filed FOIA and USCIS sent me everything on a CD.
