    Hi,

    We filed a dependent I-485 for my wife while she is on a F1 status. She has a EAD card (but my I-140 is pending). My understanding is that once she finishes school, she will not be able to get an OPT. Does it mean that she can accept employment using the EAD even though the I-140 is not approved?
    Yes.

    In case my I-140 is denied, will she lose her status and would have to leave the country?

    Hi all,
    This is urgent, your response is appreciated. I am switching jobs and my new employer wants me to go to the UK for some training in a week for about 5 days. They are sending the H1-B transfer application in couple of days, so the transfer has not been done. The img. lawer said they will send the receipt notice to me in the UK and I could travel back with my previous H1-B visa from my previous employer. I am a citizen of India woking in the STEM field for the last 2 years. I am still working and my employment will last for about 1 more week.
    QUESTIONS:
    1. Please let me know you see any problems at immigration when coming back to the US?
    2. Can the employer wait couple of more weeks before sending cancellation of my H1-B visa without paying me during that time?
    3. If I take an unpaid leave durimg this time, will that help?

    Folks:

    I did not see a specific tracker for Advanced Parole applications at the NSC. So, here's my information:

    Receipt Date: August 15, 2007
    Notice Date: September 30, 2007
    Status: Not received yet:mad:

    Has any one filed in the same timeframe and received the AP document?

    Thank you for reading this thread.
    I applied for green card via national interest waiver category, and I decided to obtain green card through consular processing. To be eligible to get the immigrant visa in my home country, I showed consulate an offer letter from a U.S. company.

    My question is , do I really have to work on that job after I enter U.S. ? Because I am not very interested in that position. And I am thinking about studying for an MBA, instead of working.
    I was given a temporary green card when I entered the custom. It usually takes 2 month to get the official green card. But if I reject that offer , would my green card be revoked ?

    Lots of activity to report. Congressional Hispanic Caucus leaders met this week with President Obama who said he wants a vote during the Lame Duck and would work the phones to round up votes. Harry Reid tweeted today that he'll offer the DREAM Act as a standalone bill which will hopefully help bring along a few of the "procedural" no voters from last September who indicated they like the DREAM Act but didn't believe in tacking it on to a budget bill.     My I-140 is approved. And we are planning to change my wife's status from H4 to F1 student. Is it ok to do that ? I heard that it will be problematic for my wife to go back on Green path. Please advise.

    Hi All,

    My H1B(8+ year) is expiring, and my company is willing to file H1B with Engg manager role. My previous H1B or extension was files for software engineer. My GC(EB2) is filed as Software engineer, with PD as Jan 2006.

    Questions
    1) Now is it ok to file H1B with new title? What if H1B gets rejected?
    2) How does this title change affect GC? Can the GC be cancelled because the title has changed or H1B gets rejected? The engg manager role is similar to software engneer role, except people responsiblities.
    3) If the H1B gets accepted, then is there still a danger to GC? Do they verify GC papers before approving H1B?

    Hi,

    I"m currently working for a TARP company and my I-94 date is Aug 2009. I still have 3 years left on my H1B.

    I've got an offer from another bank (non-TARP) and they have filed for my H1 transfer.

    a) Any idea what the wait times are these days?
    b) Anybody seen problems with H1B transfers these days?
    c) There might be a 1 week overlap (pay) between my current company and my future company. is that OK? e.g. My join date in the new company will be Feb 23rd and my notice date will be Feb 28th in my current company.
