Coming back to the discussion about EB3->EB2:
1. For all those who have already initiated the process and are aware of the delays in PERM (about 8 mos) and 140 nowadays (about 10 mos), the cost involved (close to $9k) and without a guarantee of a successful interfiling (a lot of people on this forum earlier had narrated instances of failures), what was your motivation to continue??
2. Has anyone started this process with their EB3 140 still pending?

I am not sure if it is only me.....but many times I see strangers wishing me or each other morning, evening...."how u doing" ,,,etc....
but Indians (I am also an Indian -:) are a little reserved....I do not see a greeting from fellow Indians that easily.....again I am not saying Indians are bad (cause I too am one -;)
maybe it is a culture thing for us not to greet strangers ?
PS - I have had my share of experience where non-Indians are also sometime rude me to me .....

Shows you the general herd mentality on this forum. As long as everyone is thinking the same way, everything is great. If you differ, everyone will call for a ban on you. There are lemmings everywhere. Unfortunately, I had to come to this forum for news. I have never seen such a bunch of dimwitted people at one place...
I generally really like this place but for the past week I have had about 5 moments where I've sat at my computer with complete disbelief at seeing people get banned or yelled at in mass just for being pessimistic or for not agreeing with others' opinions. You'd think it'd be due to cursing, or anti immigrant feelings, or constant spamming/waste of posts, etc, but no, all you have to do is disagree with people. Now who's this guy who inspired the flower movement and what was he about?? right.

PD, I don't agree with the phrasing of the new Labor Cert clause. That is not how I read Frist's bill. Did you make up the new labor cert clause yourself?

So labor certification is required for advanced degree holder in STEM with 3 years of US experience prior to applying will be treated as special a case.
Also, this clause says that the degree has to be from a US university. I think Attorney Mathew Oh is wrong in saying that graduate degree holders in STEM from foreign universities can apply too.

I think if USCIS start publishing the number of applications (based on PD of course) pending for each month, then we can predict our future and life will be much easier.
We are not asking for too much and I think IV can make it happen fairly easily.

I suggest, some of us send another email asking Ombudsman about this. Let us see what kind of response we get. It will be helpful to find if they got the data they requested in 2004. If they have not got it in about 4-5 years, are we also going to wait for a long time to get the data?
This case should be sent to Ombudsman, perhaps by IV, clearly stating that information is needed for decision making on PD cut off dates announced every month, which does not seemingly exist. They need it for their internal working, not for an external query by a client.
BTW, I believe they have grossly underestimated the cost. How did they estimate the cost if they don't even know what is a PD.

That sure seems interesting piyushpan. It sure seems to suggest so, but I would not be so sure as it does not say explicitly that you can apply if the priority dates are not current. What it means is that USCIS can not approve the petition, (if a petition has already been filed) unless a immigrant visa is available. Does it mean one can apply even if priority dates are not current ?? I am not so sure yet. But I hope you are right :)

Air France still does not get it. neither do other euro nations, Nor does Australia.
They are now dealing with a entirely different generation of Asians who do not care if they were once a developed nation or that they can manufacture aircrafts.
The reply is still suggestive of they taking care of the passengers and handling the situation well. No, they did not.
A technical aircraft problem is something that every airline faces everyday.
Air France not having a plan to care of non-american or non-eurpoean indians is completely their fault and outright racist. and that too a flight which is flying to India?
Did they expect everyone on the flight to be from a EU or North American nation, and that they will not require transit visas.
No, they simply did not care. They just did not make arrangement for Indian residents and hid behind the transit visa excuse.
If they wanted, they could have arranged for a Airport Transit visa for eveyone who did not have one.
But no, they assumed that regardless of how we treat them, an indian is going to fly Air France again if that is the cheapest option.
Funny is, that might be true, but that demographics is changing so fast that they better keep not caring, cos Indians will not fly with them anyways.

I share your concern, there were more than 905 in that period, I don't think the DOL data sheets have any data for NOv 04 to MAr 05. I'm not sure of the source of the original post...

Mnay companies (I know few for sure) might not applied during that period (period of uncertainity). and even after March'05 many companies were reluntacnt to apply right away. They want to see how other cases turns out. Also note that till Sep'05 EB2- Ind was current so many EB2 cases approved approved in initail phase were also got approved before Sep'05.
