I recently talked with my lawyer and also took consulting (paid $$$ for hourly consulting) with another lawyer as I am going thru the same route. Both the attorney mentioned there was no problem doing ac21 for H1 while AOS was pending for > 180 days and 140 approved .

I have got an RFE for 485 application. USCIS is asking me for Employment Letter, Paystubs and W2 for the employer I NEVER worked. (I have typed exact message below)

I worked for 'Employer #1' from Jan-2000 to Jan-2005
Then I started working with 'Employer #2' from Jan-2005 to present. Employer #2 filed my H1/Labor/140/485. I am still working for Employer #2

As long as you have had a valid h1b peition approved for employer 1 and employer 2 while you worked for them you are FINE.
According to my lawyer there is nuthing like a h1b transfer. When someone decides to move to a new sponsor that new sponsor files for a h1b via the petition but nuthing gets transfered, they need to refer to old h1b just to prove thatyou are legal and have been maintaining legal status.
in your case Employer X did so but you never joined that employer so you are fine. USCIS can get back to that emplyer if they have not cancelled your h1b as they are liable to pay you by law.
For real as you had an approved petition (latest but not the greatest) from Employer X but did not join them you are fine as long as you were still holding a valid petition with Emp # 2. You should respond back to RFE stating that you were maintaining stauts via emp#2 and were offered a job by EmpX which you never accepted. As a proof you should sen copies of pay stub for enitre period and w-2 + peition and visa copies.

Now the USCIS had made july bulletin Current again, Everyone with an approved LC can apply. But after Aug 17th The Visa numbers will be unavailable again. USCIS is not going to approve many 485 in this one month period. There may be few lucky ones to get approval between july 17th and aug 17th.
But PD matters when the new fiscal year starts in october. If the dates are retrogressed to 2003 or 2004, USCIS will approve 485 that have PDs before the retogressed dates. Above all Backlog centers are committed to clear their backlogs before sep 30 2007. So there is still hope for those stuck in Backlog Centers that their PD is valuable when retrogression strikes.
Also expect huge delays in getting EADs and APs. IV should urge USCIS to issue interim EADs if EAD is not issued within 90 days.

When you say these are the " ONLY REASONS", you should think twice. If your wife delivered baby on that day or if you had back surgery a week ago probably you would not be been in DC for the rally. So please dont generalize anything.I am not sure if the most efficient way to motivate people is to write bunch of threads with the words like the four you used many times.

you are right. many people had very genuine reasons. personally i was glad to represent them in DC. even some very committed volunteers could not make it. i do not think chandu means to generalize. he is venting his own frustrations at the very substantial number of members who simply choose not to participate...in anything...let alone a rally...

I wonder at what point of time this "three years of U.S. work experience" applies from. Is it that you should have 3 yrs exp when you applied for labor or is it when you apply for 485??
3 years experience period. It is an add on to the point system, if at all the amendment passes. At that point, there would not be any of the labor-140-485 process. You will be exempt from visa numbers, who knows what that system would be.

The answer is we all will have to bell the cat...and it will take more than a few attempts to do that.
IMHO, we should focus on what we can do rather than focusing on what some people could have done or what some one did to dampen the last attempt.
People will always find time for what is important to them; all we can do is try to make it more convenient and keep giving then enough opportunities.
We should have some sales/marketing people on this forum; they could have told us about how long it takes to convert a prospect to a customer.
Have faith my friend...
How about taking this to the next step and hire paid fulltime staff who can
1) call people and request donations
2) organize meetings
3) stimulate the local chapters
4) promote IV
..... and the list can go on.....and do all the things necessary to convert all propects to customers.
How about having full time offices in DC? This office will run on donations.
Finally, how about instead of anonymous members make this a place where everyone has to provide their personal details etc.
Anyways, I am just ranting.

The American Academy of Nursing is NOT in poor light. Did you read their prescription for the nurses staffing and issues related to it?
With comments like these, we are digging our own grave. The issue is retrogression and not hopital and health care economics. I pay USD 14000 for a family of four and by god's grace, never been to one.
I know may of these nurses who are being exploited by the bodyshops like HLG. They pay a meagre salary to nurses and exploit them on signed contract. Please, please.. use your brains minus emotion.

Addressing the U.S. nursing shortage is critical to providing quality health care, and the American Academy of Nursing (AAN) is working to identify ways to ease this shortage within our own boarders.
Your article addressed the fact that the capacity at the nation's nursing schools is limited and therefore applicants are turned away. Student capacity at nursing schools could be expanded by increasing the number of doctorally prepared faculty and making sure institutions offer the necessary pre-requisite courses for potential nurses to increase the pool of qualified applicants.
More must be done to retain qualified nurses by improving the working environment. The AAN has commissioned a task force to identify ways to have technology aid us in reducing the administrative workload of nurses in order to allow more time for patient care.
Before we look elsewhere, there is more we can do in the United States to recruit and retain talented nurses.

Can someone confirm if you can maintain accounts in the US after you leave. That sounds very dumb. I want US to keep my money and they don't want it?
I understand that after Patriot Act you can't open accounts in US without SSN but I think you should be able to keep your account because that SSN is assigned to you forever.

I am not sure about effect of patriot act, but some of my friends who left in 2002 era still have accounts here. Another friend left for Banglore but his 401K is still here.

Lets not bash anyone here. IEEE might sound anti-immigrant on the surface in true sense, its only anti H1B for all the right reason. I am not trying to defend IEEE but just getting the facts straight. Please check the attached file which is a letter sent by IEEE-USA president to Gov of Minnasota.

I have often found that people who confess to hate only one type of immigrants are just attempting to air a politically correct view of their anti-immigrant philosophy.
