    I am not as articulate as other posters in understanding/explaining recaputre, unused visa#, loaning visa# to FP......and so on. Reading all these post,I see every one are so frustated and every one want to do some thing and let USCIS know how imp these things are...but how:confused:...IDEA!!!...."FLOWERS".... I don't know why, but my long and short sense sayss....send some more flowerss again and again....

    I am curious..

    why USCIS/ DOL needs a law to re-capture visa # which were not used in previous years ?

    I mean Congress already authorized these ? Canot DOL/ UCIS make a judgement based on their own ?

    There is no law to allow re-capture of visa numbers as of yet. In fact it says the opposite in the existing laws - That the visa numbers may not be re-captured.

    There has been one case of visa recapture law passed during the Clinton administration and they did not allow a rollover recapture (I believe they recaptured the visa numbers that were lost between 1995 and 2000 only (please correct me if I am wrong about the years))

    Case filed end March 07 at Tampa mid district. They had 60days to respond , so by end May 07 should have heard

    Just before end May 07 they asked for another 30days and as a professional curtesy my attorney agreed, so should have heard by end June 07

    Just before end June the Attorney General's legal department called my attorney and asked yet again for another 30days !!! as my case paperwork with them was very thin (whatever that means) Their attorney stated on the phone they would like to resolve, again whatever that is supposed to mean

    Apparently Geoff Gorsky has not replied to his own attorney ! so their attorney has asked for all and any evidence we have on CSPA case.

    Today 6th July 07 I drove from Orlando to Tampa to hand deliver my case file, but my attorney has stated they will not be allowed more extra time as we will be at 120 days wait at end of July 07

    The CSPA is badly written and needs leglislative fix, Myself and another member have written our own draft amendment for legislation to protect all children from aging out. This has beed passed to Dave Weldon's office and in turn passed to his legislators, so will see what happens

    I will update you all as if I win my case could well assist many others if they are advised their child has aged out. If you wish to support our efforts please join www.expatsvoice.org

    More than 4 years ago when I started the process I really was looking forward to getting a GC and eventually citizenship. But a lot has changed in the last 4 years. GC process has become much harder (after 4 years I am yet to file for 140 and 485). At the same time the economy back home is booming. So the financial incentive to go thru the long process is really going down by the day.

    More than the financial factor, I have gradually started realizing that no matter how many friends I make here its never the same as having a large family network that provides for social stability for each family. Also, I have started observing aging indian couples in US who came in 60's and 70's. They look pretty lonely and sad. I guess the question I am asking myself today is, is finanical success today worth the social loss I will face once I retire?

    PS: Does anyone know how to turn a thread into a poll?


    When my labor approval came, I was very happy and even bought a house. But then retrogression happened. Now I am really tired of it, besides I only can watch my nephews nieces growing through webcam only. My brother sisters are getting older, and I feel I am drifting away from them because I hardly get much time to spend with them even when I go to India. So GC or no GC, I am going back.

    Now I am here for 2 reasons, my wife is studying, I am stuck with a house. My wife's studies are almost over. So as soon as I can break even on my house, I will go back. Period.

    My wife couldn't get an internship this year due to not having GC. She has converted to F1 after waiting for a long time, and hopefully this year will get an H1. So GC has no real value for me now. Only value GC has for me is that I can live more independently switch employers, experiment with startup ideas etc. while I am here.

    wondering how yu came up with a list of contributors.......if i provide my transfer confirmations to IV and still cannot find my name in the list then how will I trust the veracity of yur list.....

    So you are looking for motivation? Your post do not indicate that you are looking for motivation. There are those who are undecided or who cannot find enough energy/motivation to do something, and those people need motivation. You don't fall in that category. You are pretty much convinced that you don't belong here. Now you are just spoiling the environment to make sure that others all leave looking at you and mad-dog bickering. And one need not be a rocket scientist to figure that out. Its obvious. There goes your flag for "award for motivation". What's next, you need a shoulder to cry?

    Hasn't this been discussed already?

    It does not make a difference to America, if a few hundred thousand foreign workers get their GCs today or 10 years later. The people America would really be concerned about are outstanding researchers, but then these people fall in the EB1 category which is always current and so they have no cause for complaint. The other category that the US is concerned about is cheap and illegal labor, but that is not related to GCs. So in short, there is nothing about the Eb2/Eb3 GC backlog that America needs to worry about.

    The delay causes anxiety & frustration only for us applicants. So the impact is only on us.

    America is not bothered about losing outstanding researchers.

    the $20/mnth was pulled a while back- hardly anyone was signing up for monthly contributions and everyone went for the lwoest amount. all in all a shameful situation. my humble suggestion- in a lumpsome, donate the amount equivelant to 20/mnth for the next 4 mnths ie $80, then when the EAD comes you can start recurring contributions.

    i think they did revise it on July 2nd..didnt they?

    But when they revised it on July 2nd they took the original VB offline. Now they bring the original VB back online and they are asking folks look at both of them together.

    That comment was made for Family Visas, since everyone who applies on Family Visa, might not eventually get it. I read here that King said that everyon on EAD and AP is getting a free ride even thought here green card might get rejected. What does he mean by that. I tahught every process goes thorugha security check. such as I 140, H1b, AP and even EAD.

    Napoleon, thanks for those great finds. I always suspected Self-Porting is possible but with too many caveats.

    Please see IV user unitednation's experience while skirting around self-employment / AC21 issues and dealing with "financial viability/ tax returns" type interview questions. He finally succeeded in getting his GC, which still gives me reason to believe that it's possible to be independent after EAD (if you can navigate the loopholes):
