    A lot of people had applied in EB3 since EB3 was current for a fairly long time and their lawyers suggested them to do so to avoid additional documentation. Many of these people could have applied in EB2 as they had the required qualification including me (US masters). Just like you could have applied in EB1 since you have a Ph.D; but you decided to apply in EB2.

    The catagory on which a person applies for greencard doesn't necessarily reflect his/her capability or intelligence. After all, if Michael Dell or Bill Gates had to apply for green card they had to apply in EB3. On the other hand, a lot of EB2 filers just fabricated their resumes with years of experience to qualify for EB2. But that shouldn't overcast shadows on real EB2 peoples ability.

    I don't know from where you got your Ph.D but it definitely didn't inprove your ability to think rationally as evident in your post.

    Been here since 1996 and have a doctorate .. but still in EB2.. and i don't regret it .... but i don't want anymore line jumping for sure.

    There are so many unknowns.. that I don't think we can really estimate the EAD process timeline.
    For instance, lets consider we all get our initial EADs (in whatever time estimation one can make with the little information one have), I believe, it will be really interesting to see how much time USCIS takes to renew EAD's. Currently it has to be renewed yearly.

    They would definitely have to either increase work force or increase grant EAD renewal's of 3 years in order to cope up with the number of applications.

    I hope they would have decided all of this before accepting all AOS applications otherwise they would have to do alot of leg work.

    We will see in future what they have in store for us.

    Made my first contribution of $100. Joined 10 odd days back and it helped immensely to have the community support going through the roller coaster!! Thanks to everyone for their efforts.

    Did not want to say this before I contributed, but I still believe that the forum should not be only for paying members. By having certain parts of the forum open to public we can convert lot more people like me as opposed to asking for money right from the get go.

    OK here is a question.
    Person working for past 4 years in the US.
    Applied LC this February (2/26/07)
    wants to go to canada and then reenter may be next year.
    According to the new point based GC system--
    1) Will the person get points for the 4 years of work in the US? (those 4 years were continuous, however, the person applies for GC after the canadian break of lets say 1 year)

    I have seen my friends refinancing, received mixed results.

    Few say, can not approve loan because of temproary status (They have no answer for why they allowed last year when purchasing the home).

    Same guys were able to get it done thru other banks.

    EAD - is not popular as H1B in the financial area. They don't understand. You have to give this as a supporting document along with your H1B Visa and I-797.

    Ok, so I saw the video. I am confused by his analogy and I am a scientist. Maybe it is the lack of data analysis and graphics he keeps referring to. He is not a great speaker. I stopped watching it midway.

    BTW, I am a student from a so called 'garbage' Indian education system and a graduate of Duke University.:p

    From reader "MA", the blog TalkingPointsMemo.com -he's referring to the slowdown in criminal cases at the USA office in SF, not immigration. But interesting, nonetheless:

    Your post . . . about the slowdown in cases in San Francisco got me thinking about the larger bureaucratic issue associated with more than half a dozen years under Bush.

    This is a relatively trivial incident, but a while back I attempted to get my passport renewed and discovered the wait times had doubled (partly because of the new rule requiring travelers to Canada to have passports) -- trivial, yes, but it also highlights some of the more mundane effects of an administration run by people who have a fundamental antipathy toward government service and government programs.

    This gets writ large in the case of incidents like Hurricane Katrina, the prosecution of the Iraq war and so on...but it also gets writ small in thousands of details of everyday bureaucratic life -- especially as the Bush influence trickles down through the bureaucracy from political appointees to career employees.

    If the governing Bush/Cheney philosophy is that the public sector doesn't work, that it is inherently not just inefficient and corrupt, but antagonistic to citizens and individuals, this philosophy has a way of slithering its way into the workings of the system itself -- not just in the case of high profile corruption scandals, but also, again on a more mundane level, in the day-to-day operation of government bureaucracies.

    And here's the weird thing, even though that sounds so unexciting, there's something almost stifling about imagining a bureaucracy that really is antagonistic to individuals -- one that not only slows down, but finds some vindication in throwing up road blocks, thwarting citizen requests, and, in the end, not serving the public. I have family members who lived in former communist countries -- and that's really how the bureaucracy was there, and life under those circumstances was made much more difficult, bureaucratic responsibilities increasingly cumbersome, much of the time the system just didn't work, and had to be gamed (or bribed).

    Although I have large scale concerns about Bush's handling of the war, the economy, and so on, I also have some more micro scale concerns about what his philosophy of governance means for everyday life and our everyday interactions with the bureaucracy. Indeed, this scale, though more mundane, is also the one that in some ways affects the majority of the population more directly, even if much less dramatically. I've lived in places where the bureaucracy functions quite well, and where citizens take a certain pride in the fact that the government serves them.

    The idea of living in a country where the administration's goal is to demonstrate just how bad government is/can be scares me at this very prosaic level -- I want my schools and courts and inspection agencies and passport agencies and so on to be run by people who really believe in government service and in the fact that the government can work effectively to serve the populace. Bush seems to be doing everything he can to dismantle such a world -- and he risks fueling a vicious circle in so doing

    None of the organizations succeed without making people accountable for their actions or inactions. This is true in the case of IV as well. We are all individually accountable for the current state of affiairs at IV, either good or bad, and we must accept or atleast acknowledge that before looking for solutions.

    Before going for big ticket items like leadership change, elections and other politics let us focus on what we can improve instantly or in the near future. We all know that in the immigration process, there are only few factors or variables we can control, and rest lies with employer or DHS or USCIS or U.S. Government. One thing we can control is how we can improve our actions so that our voices will be heard to those who can act on our behalf. The list includes legislators, senators, media and local immigration community based organizations.

    As a first step, let us add 'ACTION ITEMS' tab on the menu of IV home page. This action items tab will have list of 'to-dos' by all members on a monthly basis. These simply include, say, in July-09, every member should send one fax to local legislator, or write a letter or e-mail to media organizations like CNN, Business Week etc. We may do the same thing with different but similar content based on how events un-fold on a monthly basis. Now, the leadership with the help of other volunteers should come up with monthly agenda, and provide tools like - format of letter, content etc. The other member should just have to follow.

    I will conclude with a quote from Anthony Robbins (great leadership coach): "Your life will not change by reading or listening....your life will only change by action". Let us make every one accountable in this process.

    Do you mean to say, the employer just sends a letter with a signature and LIN numbers to revoke and USCIS revokes them?

    In that case does USCIS send a confirmation of revocation of all the requested LIN numbers to be revoked? Or it is just a one-sided handshake?

    Yes, I think it is just a letter.

    Just like say, you do not want your Green card - you send a covering letter to USCIS and enclose the green cards. They shred the cards and process the letter update their records.

    You can also send a letter to USCIS to withdraw your 485 - they will be happy to do so.

    My dad had a expired green card (in the 70s) and recently when he went to consulate to get a toursit visa - he presented his expired green card (30+ years old) and they took him aside and completed some paperwork and took the expired green card and said they gonna process the return of expired green card - this is normal paperwork and procedure they follow.

    What baffles me is - they follow all the laws perfectly - but when it comes to beneficiaries, we see all sorts of issues? I really do not think it is a training issue - this could be something else - maybe I am just speculating

    They posted the revised bulletin in a hurry. They should have done this on July 2nd. The actual july bulletin consists FB dates and other dates.

    and why, pray, does your esteemed school keep accepting students from these so called "sub-standard" colleges in india? i would say 5-7 years of observed emperical evidence calls for some substantial action on your and your school's part in black-listing these institutions........so, either:

    1. you are blowing smoke through eveyone's a** here or
    2. the school is greedy for tuition fees - proving an earlier contention made in this thread about it being all about money....

    P.S - i am not from one of these schools so no personal stake!

    For 2. However, it is not really about greed, but necessity.
